KUALA KANGSAR: P. Uma Mageswari was a relieved woman after she was acquitted of a charge under the Official Secrets Act 1972 at the Sessions Court here.
The 27-year-old, who worked in SJKT Keruh in Pengkalan Hulu for over three years now hopes to be reinstated into her school.
“I want to go back to teaching. I would like to thank my lawyers who guided me throughout the trial. I was afraid but they instilled some bravery in me.” she said to reporters after Judge Niran Tan Kran explained his decision to acquit her.
The judge said the prosecution failed to establish a prima facie case against the accused and after 20 days, the sessions court decided to acquit her of the charges.
Uma was represented by M. Kulasegaran and Augustine Anthony while N. Jayanthi prosecuted.

Two other Tamil school teachers, in Kuala Kangsar, Perak, and an engineer in Kemaman, Terengganu are facing similar charges.
P. Uma Mageswari, 28, is being charged under the Official Secrets Act 1972 (OSA) for being in possession of several pages of the Science paper in her Samsung Ace smartphone.
Her trial began yesterday and is being presided by judge Johari Hassan.
Uma and her colleague, K. Anparasu, 50, were charged in November last year, under Section 8(1)(c)(iii) of the OSA, which provides a jail term of between one and seven years.
Anparasu was slapped with three charges – being in possession of several pages of the Mathematics 1 and 2 and Science papers in his Samsung Trend smartphone.

The acquittal by the Seremban Sessions Court of two teachers who were charged over leaked UPSR examination papers is not necessarily binding over the trial of another school teacher being charged in Kuala Kangsar, Ipoh, for unauthorised possession of the exam papers last year, lawyer M. Kula Segaran said today.
Kula Segaran, who is representing P. Uma Mageswari, 28, from SJKT Keruh in Pengkalan Hulu, said both courts were considered as having equal jurisdiction.
“However, it is considered persuasive due to both cases having more or less similar facts.
“If there is a different decision, the court must have good and absolutely crystal reasons,” the Ipoh Barat MP said.

Teachers charged over UPSR leak freed without defence called
Two Tamil school teachers were acquitted without their defence called for unauthorised possession of copies of last year’s primary school achievement test (UPSR) examination papers.
Seremban Sessions Court judge Datuk Jagjit Singh in freeing Subbarau Kamalanathan and Murugan Palanisamy said having examined all the evidence, the court found that the prosecution had failed to establish a prima facie case against the two.

UPSR leak: Two Tamil school teachers acquitted
SEREMBAN – Two Tamil vernacular school teachers were acquitted and discharged by the Sessions Court here for allegedly being in possession of official secrets related to leaks in three Ujian Penilaian Sekolah Rendah (UPSR) examination papers last year.
L.Subarau@ Kamalanathan 36, from SJKT Ladang Batang Benar and Murugan Palanisamy, 34, from SJKT Ladang Lenggeng were jubilant when judge Jagjit Singh Bant Singh delivered his verdict on Thursday.
The duo had on Nov 5 claimed trial to six counts of being in possession of official secrets and sharing the information with others in relation to the leak in three UPSR papers.

Two teachers charged with possessing UPSR examination papers
KUALA KANGSAR: Two Tamil primary school teachers claimed trial to four counts for having in possession UPRS examination questions illegally stored in their handphones.
K. Anparasu, 50 and P. Uma Mageswari, 27, from SJKT Keruh in Pengkalan Hulu pleaded not guilty when the charges were read to them by a court interpreter before Sessions judge Johari Hassan Thursday.
Both were charged under section 8 (1) (c) (iii) of the Official Secrets Act, which provides a jail term of between one and seven years.
They allegedly committed the offences in September during the UPSR examinations.
Anparasu was slapped with three charges namely for being in possession of the Math 1, 2 and Science papers stored in his smart phone.
Uma was charged for being in possession of the Science Paper stored in her handphone.

SHAH ALAM: Selangor recorded a slight decrease in the number of students who scored straight A’s in Ujian Pencapaian Sekolah Rendah (UPSR) this year.
State education director, Zainureen Mohd Noor said 6,593 students scored straight A’s this year compared to 7,914 last year from national schools and national vernacular schools.

Education Department: Leaks and re-sits caused UPSR pupils to ‘lose interest’
IPOH: Leaks and subsequent re-sits during this year’s UPSR examinations caused some pupils to “lose interest”, which was a factor in the decline of number of those scoring straight As in the state, said Perak education director Mohd Idris Ramli (pic).
Mohd Idris said he believed the leak in the examinations was a factor which affected the performances from the pupils in the state, with 2,847 straight-A pupils this year compared to last year’s 3,249.
“The issue has caused some pupils to lose focus while there were some who became disinterested because they had to re-sit the papers,” he told journalists after announcing the UPSR results at SK Marian Convent here Wednesday.
More than 470,000 pupils throughout the nation had to re-sit the examinations because of the leaks in September.

Why no charges yet against UPSR exam leak culprits, asks parents group
More than a month after the UPSR exam papers leaked, a parent’s group representative today wanted to know what the outcome of the police investigation was.
Parents Action Group for Education (Page) chairman Datin Noor Azimah Abdul Rahim said the leaks in the UPSR exams last month resulted in more than 470,000 Primary Six pupils having to resit four of the papers but to date no one has been brought to book for it.
“Those who were detained are on police bail and have not been charged. Why are the authorities taking so long?” she asked.

Kuala Lumpur Criminal Investigation Department (CID) chief Senior Assistant Commissioner Gan Kong Meng on September 21 had said that the police had interviewed 30 people and investigation papers would be referred to the Attorney-General’s Chambers to determine if there were sufficient grounds to charge those detained under Section 8 (1) of the Official Secrets Act 1972 for possession of official secrets and communicating such information to others.
Police had recorded statements from eight officers from the syndicate, 19 teachers, an officer from the Education Ministry, a journalist and an engineer.
In the process, 14 people were detained but later freed on police bail.
However, none have so far been charged with any offence.

Dyslexic pupil sues govt for negligence over UPSR
KUALA LUMPUR: A 13-year-old boy with dyslexia has filed a suit against the director of the Malaysian Examinations Board and the government for negligence in the handling of this year’s Primary School Achievement Test (UPSR) examination papers, some of which he had to resit.
K. Mangala Bhavani filed the suit on behalf of the pupil, Ananda Krishnan Menon, at the Civil High Court registry on Oct 13 through the legal firm of Messrs Rajadevan & Associates.
The case has been fixed for case management on Nov 12. In the statement of claim, Ananda Krishnan, a pupil of Sekolah Kebangsaan Taman Tun Dr Ismail 2, said the defendants had failed to implement a safe system to ensure there was no leak of the examination question papers.
He also said that the defendants failed to supervise employees and their agents – lawful representatives – to ensure that the question papers did not leak from the beginning of the process of preparing the questions till the process of distributing the question papers to all schools in Malaysia.

Naming the Malaysian Examinations Syndicate and Putrajaya as defendants, Ananda said the government did not take action against the examinations syndicate members and their agents over the leaks.
“Instead, the government set up an independent committee to review its standard operating procedure in the conduct and management of public examinations,” the schoolboy said in the legal suit.
He said the syndicate, its employees or their agents were negligent which resulted in the leak of the Science, English, Mathematics and Tamil papers.
He added the syndicate had failed to provide a safe system in ensuring there was no leak and failed to supervise its employees from the time the examination papers were sent to all schools nationwide.
He is seeking aggravated damages for the mess created by the syndicate.
The examinations syndicate is entrusted to prepare and print question papers for all public examinations as these documents are classified under the Official Secrets Act before the examinations start.

Latest report in UPSR leaks made to justify arrest of Tamil teachers, says Hindraf
Hindu rights group Hindraf today said the police report lodged over purported leaks in the Tamil and Maths papers for the UPSR examinations was just an attempt by the Education Ministry to justify its arrest of Tamil schoolteachers.
Hindraf chairman P. Waytha Moorthy asked why the report was only made almost 11 days after the examinations and only after the group had raised concerns over the arrest of 10 Tamil schoolteachers over the leaks in English and Science papers.
“If the alleged leak in Tamil schools was reported to police today (yesterday), why then did police arrest those 10 teachers from Tamil schools days before there was any complaint of a leak?” he asked in a statement.
“Why is the Examination Syndicate hurriedly making this report on a Sunday especially after Hindraf alleged a possible racial witch-hunt to pin the blame on Tamil schoolteachers when the alleged leak was at the Sekolah Kebangsaan (national school)?”
Waytha Moorthy also said there was no complaint of any leak in Tamil school exam papers prior to the arrests of the 10 teachers.

He said since the initial allegation of leaks was over exam papers from national schools, “top officers” in the Examination Syndicate should have been detained instead, as they were in charge of the safe rooms where the papers were stored.
“Looking at the current scenario and the latest police report hurriedly made on a Sunday by an officer from the examination syndicate, it appears and gives the impression that there is indeed a further cover-up being attempted by unseen hands at the top level in the Education Ministry,” he added.
“Is there a deliberate attempt to divert the attention of the public as the pressure is building for the Education Minister to take ministerial responsibility by resigning?”

UPSR: Probe over alleged leak in Tamil, Maths papers
KUALA LUMPUR: The Malaysian Examinations Syndicate lodged two police reports alleging that the Tamil and Mathematics Ujian Pencapaian Sekolah Rendah (UPSR) examination papers were leaked.
Police chief Senior Deputy Comm Datuk Tajudin Md Isa confirmed receiving the reports from the Examinations Syndicate officials on Sunday and that a fresh investigation would be launched.
“We will be investigating the reports with the same team which has been on the case of the first two papers,” he told The Star.

‘Crackdown on UPSR leak suspects racially motivated’
Persatuan Hindraf Malaysia today questioned whether there is a racial witch-hunt in the arrest of 10 teachers from Tamil schools with regard to the leaked Primary School Achievement Test (UPSR) examination papers.
Its chairperson P Waythamoorthy said the leaked papers involved national schools, not Tamil schools.
“Hindraf is wondering if the Education Ministry and the police are pinning the blame elsewhere with the arrest of such large number of innocent Tamil school teachers,’ Waythamoorthy said in a statement today.

Meanwhile, the former deputy minister was also “appalled” with the “lack of respect” given to the teachers.
“They were forced to wear the lock-up uniform and dragged to court to be remanded.
“This demeaning treatment should not have been given to those in a noble profession,” he said.
Investigate the real culprits
Waythamoorthy urged the Education Ministry to investigate the “real culprits” who were in charge of the Examinations Syndicate and responsible for the secrecy of the examination papers.
“The fact that no arrests were made of high-ranking Education Ministry officers creates reasonable suspicion and gives the impression that there could be a hidden agenda to conceal the truth,” he said.

Two more teachers arrested in connection with UPSR leaks
KUALA LUMPUR: Two more teachers were arrested in connection with the Ujian Pencapaian Sekolah Rendah (UPSR) Science and English examination papers.
Both the male teachers, aged 48 and 51, were nabbed in Bedong, Kedah at about 5pm yesterday, said city CID chief Senior Asst Comm Gan Kong Meng. This brings the number of arrests in connection with the leak to 14 with 12 of them teachers, one an insurance agent and one an engineer.

In Putrajaya, police are probing whether those who leaked the UPSR papers were also responsible for leaking exam papers in previous years.
Home Minister Datuk Seri Dr Ahmad Zahid Hamidi said police are also checking on possibilities that a network among educators could have existed to provide certain quarters with access to the exam papers.
“So far those arrested are from the education sector, including school teachers and principals. We believe that there is a network among educators that provide easy access to the exam papers. No VIPs have been arrested,” he said during a press conference yesterday.

UPSR leaks: Three teachers remanded for four days

PUTRAJAYA: The police today obtained a four-day remand order against three teachers, one of them a woman, to assist in the investigation into the leak in the Science and English examination papers of this year’s Primary School Achievement Test (UPSR).
Magistrate Nur Dahlia Azmi issued the order, with effect from today, against the trio, aged between 24 and 36, for investigation under Section 8 (1) of the Official Secrets Act (OSA) 1972.
The teachers were arrested in Negri Sembilan last night.
On Monday, four men were remanded for four days until tomorrow.
Yesterday, the police obtained a four-day remand order against an engineer.

If it was in the exam paper, then some questions need answers:
1. What aspect of Bahasa Melayu was this question testing the pupils on?
2. What is the evidence on which this question is based that only one of the listed communities is known to practise these values more than the others?
3. Is the question (if it was indeed in the paper) in keeping with the spirit of 1Malaysia?
4. Why was the question which is racist in nature put in the exam paper?
I tried to get a verification and sent e-mails to two officers in the examinations division, ie rofizah.jamaluddin @moe.gov.my and johara.wahab@moe.gov.my, but have not received any response.
It is important for the Education Ministry to clear the air on this – was there such a question in the Malay language paper or not? If there was, why? – September 16, 2014.

Ministry denies racist question in UPSR exam paper

PETALING JAYA: The actual Ujian Penilaian Sekolah Rendah (UPSR) Bahasa Malaysia examination paper did not include the alleged racist question that had gone viral on social media, the Education Ministry said today.
“We received complaints about the matter on Sept 8, before the UPSR Bahasa Malaysia exam. The ministry would like to confirm that it was neither a question in the exam paper nor the ministry have any role in formulating the question,” a spokesman told theSun today.
The question which asked students to identify which race relates to the good values listed had been circulated on several social media sites, garnering various responses from Malaysians who questioned how the values only relate to one particular race.
The ministry also condemned the act of irresponsible parties taking advantage of the current situation by spreading these rumours and thanked the public for highlighting the matter.
Many were angered by the so-called racial profiling imposed on pupils.

UPSR leak: Four including headmaster remanded under OSA
PETALING JAYA: Four people, including a headmaster have been remanded for four days in connection with the leaked Ujian Penilaian Sekolah Rendah (UPSR) papers.
Kuala Lumpur CID chief Senior Asst Comm Gan Kong Meng said the suspects aged between 30 and 50, were remanded until Sept 18 to facilitate investigations into the leaked papers.
“Those arrested have been remanded to assist the police with the investigations.
“They are being investigated under Section 8 of the Official Secrets Act 1972,” he said when contacted on Monday.
The others detained were two teachers and an insurance agent.
SAC Gan said police also recorded the statements of 12 people, including six Education Ministry’s Examinations Syndicate officers and five teachers.

UPSR: Cops record statements of seven individuals
The police have recorded statements of seven people to facilitate investigations into the leakage of question papers for the Ujian Pencapaian Sekolah Rendah (UPSR) examination for Science and English.
They comprise six officers of the Malaysian Examinations Syndicate (LPN) and a journalist.
Kuala Lumpur CID chief SAC Gan Kong Meng said the police were gathering evidence from numerous quarters to identify the culprits behind the incident.
“To date, seven statements have been taken to assist in investigations. There has been no arrest, thus far,” he said when contacted by Bernama today.

UPSR leak: Two top Education chiefs suspended
VIENTIANE: Malaysian Examinations Syndicate chief Dr Na’imah Ishak and deputy Dr Wan Ilias Wan Salleh have been suspended with immediate effect over the leak in the Science and English papers.
Bernama reported Deputy Prime Minister and Education Minister Tan Sri Muhyiddin Yassin announcing the suspension of the two top heads.
Muhyiddin said Education deputy director-general (Teaching Professionalism Development Sector) Datuk Misrah Ibrahim would take over the duties and responsibilities of the director during the period of suspension.

He said the decision to suspend the duo was taken because they had to take responsibility for the fiasco which resulted in the cancellation of the English 014/1 and 014/2 and Science 018, 028 and 038 papers.

UPSR probe: Four ‘hotspots’ found, ‘traitors’ identified
PUTRAJAYA: Authorities have found four “hotspots” and zeroed in on several individuals in the investigation of leaks in the Ujian Pencapaian Sekolah Rendah (UPSR), said Second Education Minister Datuk Seri Idris Jusoh.
The authorities comprise representatives from the Education Ministry, the police and Malaysian Communications and Multimedia Commission (MCMC).
Speaking at a press conference at the Malaysian Examinations Syndicate here, Idris said the teams turun padang on Thursday.
However, he declined on Friday to reveal which states the hotspots were in, saying it was under investigation.

EVERYWHERE SHOCKING DISHONESTY: Leaked exam papers ‘going on for years’ – educationists
PETALING JAYA – Cases of examination papers being leaked was nothing new and have been going on for years.
Parent Action Group for Education (PAGE) chairman Datin Noor Azimah Abdul Rahim said such cases had always been swept under the carpet as the standards set by the Malaysian Examinations Syndicate makes it almost impossible for a “leak to be considered a leak”.
“Although it has been going on for years, the (exam) syndicate has been hesitant to admit to it as there are certain criteria which have to be met,” she said.
“I have heard of the authorities only declaring a leak if the front page of the leaked paper were the same as the actual examination set.”
She said this meant it would not be considered a leak if the font size of the question did not match that of the actual examination papers.
“Many get away with it and we have heard of such things going on for years,” she said.
Azimah said it was high time the ministry treat the matter seriously and a special panel must be set up to investigate and find ways to put an end to it.
“Those behind this should be seriously remanded to deter such things from happening.”

Perak teacher not involved in UPSR leak

IPOH: The Perak Education Department has denied claims on social media that a Perak-based teacher has been picked up for leaking the Ujian Pencapaian Sekolah Rendah (UPSR) Science paper.

“We did not receive any report of such leaks in Perak,” he said, when contacted today.
It was reported that the teacher was allegedly picked up by the Malaysian Anti-Corruption Commission (MACC) with the assistance of the Education Ministry.
The teacher was said to be from a national school located in the rural areas.

Muhyiddin cries sabotage over UPSR leak

Deputy Prime Minister Muhyiddin Yassin believes that the leak of two examination papers could be an attempt to sabotage him and the Education Ministry.
Muhyiddin, who is currently in Laos, was commenting on the leak of the Science and English papers for Ujian Pencapaian Sekolah Rendah (UPSR) examination for Standard Six pupils.
According to an Utusan Online report, the deputy minister, who also oversees the education portfolio, was livid and saddened by the incident.
He said immediate action has been taken to trace the source of the leak and also to re-examine the Standard Operating Procedure (SOP) for the preparation and handling of the examination papers to prevent a recurrence.

Quit if more exam paper leaks, DPM told
Deputy Prime Minister Muhyiddin Yassin should promise to resign if any leaks are identified in future major examinations following the leak of the Ujian Penilaian Sekolah Rendah (UPSR) Science and English papers.
DAP parliamentarian Ong Kian Ming said Muhyiddin, who is also education minister, could show his commitment to protecting the integrity of the country’s school examinations by promising to resign.

The Serdang MP also believes that it was not sufficient for Muhyiddin to apologise for the examination paper leakages.
“He must give the assurance that such leaks will not occur for the UPSR Science paper which will be taken on Sept 30,” he said.

Idris Jusoh: UPSR English papers leaked
PETALING JAYA: The Education Ministry has confirmed that there was a leak in both the UPSR English papers.
Pupils who sat for their UPSR English examination on Thursday will have to re-take their papers, according to Second Education Minister Datuk Seri Idris Jusoh.
He said the ministry confirmed on Thursday morning that the English 0141 and 0142 papers had been leaked.
Vernacular school pupils will not be affected as they sit for different English papers.
“We only confirmed it this morning at 11am; we will announce the new date for exams soon because we need to discuss and see how soon we can organise all the logistics involved.
“If possible, we’re aiming to have the re-sit on Sept 30, the same day as the rescheduled Science papers.

KUALA LUMPUR: The Mathematics 1 paper for Ujian Penilaian Sekolah Rendah (UPSR) is believed to have been leaked and spread to more than 400,000 exam candidates who sat for the paper on Wednesday morning.
A teacher who recently contacted Astro AWANI allegedly received photos of the leaked questions and answers through WhatsApp at 7.40am – the Mathematics paper started at 8.15am.
The teacher who refused to be identified added that some friends had also received the leaked questions, some as early as Tuesday afternoon.
“The Mathematics question that I saw through WhatsApp was the same with what came out,” the teacher said.

UPSR Science paper leaked, sitting postponed
PETALING JAYA: The Science paper for the Ujian Pencapaian Sekolah Rendah (UPSR) has been leaked and the sitting has been postponed from Sept 11 to Sept 30.
“The Malaysian Examinations Syndicate has discovered that the Science 018, 028, 038 examination papers, scheduled for 8.15am to 9.30am on Sept 11, has been leaked, ” it said in a statement, adding that initial investigations showed that contents of the paper were spread through social media.
It said that the Science 018, 028 and 038 papers would now be postponed to Sept 30 from the original Sept 11 date.
It added a report has been made to relevant authorities to conduct investigations and for full legal action.
Second Education Minister Datuk Seri Idris Jusoh took to Twitter to apologise to students and parents for the leak.

im a year six student and im sitting for the exam.. i prepared for all my subject in upsr including scince and maths for sure.. but what have they done?? leaked out the question and all the answers?? thats not fair to all of the students who sits for the upsr test.. i felt so sad when i heard someone says that the questions had been leaked out… all i can say is that is nothing :).. i hope that we sjk dont need to re test our english papers and other subject.. please i hope this kind of things wont happen again:) that all.. but still…sad and feel like no hope 😦
