Surendran fails in bid to refer sedition case to Federal Court

KUALA LUMPUR: Padang Serai MP and lawyer N. Surendran failed in a bid in the High Court to persuade it to refer the constitutionality of the Sedition Act to the Federal Court. Latheefa Koya, Surendran’s lawyer, said they will be appealing against the decision to the Federal Court.

Judicial Commissioner Ab Karim Ab Rahman ruled that the three questions posed by Surendran in challenging the Act have been answered in Prof Azmi Sharom’s challenge. “The three questions have been answered. The High Court does not need to refer the questions to the Federal Court,” he said.

The three questions are whether the Sedition Act was constitutional, whether the Act violates Articles 5, 8, 10 of the Federal Constitution and whether intention being irrelevant was unconstitutional.

JC Ab Karim ordered Surendran to go back for trial at the Sessions Court. “The next mention date at the Sessions Court will be on April 21,” he said.

Surendran was charged for sedition on 28 August 2014 for the comments he made in a Youtube video on Anwar Ibrahim’s conviction in Sodomy 2.

Subsequently, he filed an application in the High Court to refer the questions of constitutionality to the Federal Court.

Anwar’s lawyer charged in court with sedition

PKR vice-president N Surendran today claimed trial to a sedition charge at the Kuala Lumpur Sessions Court.

If found guilty, the PKR vice-president stands to face a maximum three-year jail term or a maximum RM5,000 fine or both.

The Padang Serai MP is charged with sedition for allegedly saying that the Anwar Ibrahim Sodomy II charge is false in a press release on April 14.

DPP Syed Faisal Syed Amir, who represented the prosecution, asked that bail be set at RM10,000.

However, lawyers M Puravalen and Latheefa Koya told the court that Surendran is a MP and a lawyer, so a nominal sum should be set.

In an immediate reaction, Human Rights Watch’s Phil Robertson criticised the government for hauling Surendran to court.

“The government’s decision to charge N. Surendran with sedition today is yet another blatant example of a draconian law being used to violate freedom of expression and silence critics.

“This is part of a clearly emerging Malaysian government campaign to systematically pursue its political opponents using trumped up charges under the Sedition Act,” he said.

He added that by engaging in legal harassment and persecution of opponents using a law that is an relic of colonial authoritarianism, Najib demonstrates that he apparently has no abiding commitment to either political moderation or human rights.

“His prior pledges to amend the Sedition Act sadly stand revealed as hollow rhetoric designed to deceive both Malaysians and the international community,” he added.

Anwar’s lawyer arrested for sedition

PKR vice-president N Surendran is scheduled to be charged with sedition in a Sessions Court tomorrow for for his comments on the party’s de facto leader Anwar Ibrahim’s Sodomy II case.

PKR vice-president N Surendran was arrested this evening for sedition over his comments on the party’s de facto leader Anwar Ibrahim’s Sodomy II case.

The party’s legal bureau chief, Latheefa Koya, said Surendran was arrested at 7.25pm and will be charged tomorrow.

“Yes, he is still under arrest right now, photograph and fingerprint being taken.

“Then he will be bailed out and charged tomorrow,” she told Malaysiakini.

Surendran, who is Anwar’s lawyer in the Sodomy II case, had gone to the Pudu police station after a warrant of arrest was issued against him.

Latheefa described the charge which Surendran is likely to face as outrageous as his statement had yet to be recorded. However, police have proceeded to charge him.

She guessed that the authorities are acting on the police reports lodged against Surendran.

Anwar: Umno ‘interfering’ in Sodomy II appeal

Opposition Leader Anwar Ibrahim has accused Umno of trying to interfere in his sodomy conviction appeal before the Federal Court after his lawyer was bombarded with police reports by the party.

“These attacks upon my lawyer N Surendran are a clear and blatant interference by Umno in the pending appeal, as it is a direct attempt to prevent grounds of conspiracy from being raised by my lawyers,” Anwar said in a lengthy statement this afternoon.

The PKR de facto leader also said Umno divisions nationwide have lodged hundreds of police reports against Surendran, who is acting for him in the Sodomy II case.

“Among others, top Umno leader Mukhriz Mahathir has publicly called upon all Umno divisions to lodge police reports, whereas an editorial in Umno-owned Utusan Malaysia has called for immediate action against my lawyer,” he said.
