Under Islamic law, unmarried men and women are prohibited from coming together in a secluded place, or in a house or room under circumstances which may give rise to suspicion that they were engaged in immoral acts.

‘Mahram’, also pronounced ‘muhrim’ in Malay, is a concept in Shariah law that refers to unmarriageable kin, such as blood relatives.

IN THE EVENT OF A KHALWAT RAID ON A HOTEL, THESE ARE THE RULES
1. Hotels are not allowed to open the door for the religious authorities.

2. The religious authorities cannot ask the hotels who is staying in a certain room or which room is a person staying in.
3. The religious authorities also cannot go knocking door to door.

Religious authority catches married woman having affair with non-Muslim lover

A husband called the Terengganu Religious Affairs Department (JHEAT) based on the suspicion that his wife was having an affair with a man, and the third party turned out to be a non-Muslim.
.
The scandalous affair was exposed when JHEAT officers conducted a raid against a hotel located in Kuala Nerus after the husband lodged a report.
.
During the 7.35am operation, the woman had claimed that she had fallen in love with the man after he helped to expand her business.
.
JHEAT commissioner Datuk Wan Mohd Wan Ibrahim said the husband had alerted the religious authorities after seeing his wife and lover entered the hotel.
.
“Although he was disappointed and upset, he did not take action by himself but called the religious authorities instead,” he said.

The scandalous duo were caught naked and were brought to JHEAT office for further investigation.

Wan Mohd said they would be investigated under Section 29 of the Terengganu Syariah Criminal Offences (Takzir) Enactment 2001.

To avoid a khalwat arrest, always sit at the back of a Uber or Grab car and never, ever talk to the man driver unless necessary.

Federal Territories Mufti says that close proximity between a man and a woman without marital ties also applied to those who travel together in the same vehicle.

PETALING JAYA: A mufti today zeroed in on the religious view of opposite sexes sharing a Uber or GrabCar ride, saying it could come under the definition of “khalwat” or close proximity, an offence under Malaysian shariah laws.

Federal Territories Mufti, Zulkifli Mohamad Al-Bakri said the definition of khalwat, or close proximity between a man and a woman without marital ties, was also applicable when they travelled together in the same vehicle.

“It does not matter if khalwat takes place at parks, lakes, or in a room or hotel. Likewise in a vehicle used for as taxi, Uber or Grab,” he said, writing on the official website of the FT Mufti.

But Zulkifli said circumstances dictated that the rule on khalwat could be suspended in a Uber or Grab setting provided the passenger, upon knowing that the driver was from the opposite sex, is seated at the back.

In addition, he said the passenger should also not engage in a conversation with the driver “unless it is really needed”.

He added that the driver should also avoid isolated routes.

“This way they will be shielded from any form of slander,” he said in a posting accompanied by religious texts to back his arguments.

Foreigner caught for khalwat … with two lesbians

A foreign man was caught for khalwat (close proximity) with two local women during a raid conducted by the Terengganu Religious Affairs Department (JHEAT)on Tuesday.

The trio were arrested in a house located at Jalan Kemajuan in Kuala Terengganu.

The 21-year-old man, who is a car washer, claimed that he had only stayed for three days in the rented house owned by the two lesbians, aged 18 and 20 years old.

JHEAT commissioner Datuk Wan Mohd Wan Ibrahim said a report was lodged earlier over the man’s presence there.

According to Wan Mohd, the man said he was temporarily staying with the women while looking for a new job.

“During interrogation, the two women admitted that they were a lesbian pair,” he said. All three were arrested under Section 31 of the state’s Syariah Criminal Offences (Takzir) Enactment 2001 and were released on bond.

BANDA ACEH: An Indonesian man collapsed while being publicly caned Monday for spending time with a woman who is not his wife in contravention of strict Islamic laws in a staunchly Muslim part of the country.

Married couple sues JAWI after traumatic khalwat raid

KUALA LUMPUR, Feb 17 — A husband and his wife today sued the Federal Territories Islamic Religious Department (JAWI) for raiding and arresting them for khalwat or close proximity.

Mohd Ridhuan Giman, 34, and Siti Sarah Maulad, 26, who have been married for three years, are demanding an apology from JAWI for their traumatic experience that resulted in injuries and their wrongful detention even after showing proof of their marriage.

According to their lawyer Yusfarizal Yussoff, an enforcement team from JAWI consisting of seven male officers and one female officer had raided the couple’s budget hotel room in Kuala Lumpur on January 8 at about 1.30am.

Yusfarizal said the male officers had forcefully entered the hotel room despite being told by Mohd Ridhuan that his wife inside was not dressed appropriately, adding that it resulted in a scuffle that caused the husband’s neck to be injured.

“Although the husband had repeatedly told the said officers that they are husband and wife and showed the officers the photo of their marriage certificate on his hand phone, the officers refused to accept the explanation.

“Instead, the male officers had directed the wife, in front of her own husband, to put on her clothes in front of the male officers. One of the officers kept on taking pictures and video despite being told of our client’s marital status,” he told reporters at the court complex here immediately after filing the lawsuit.

Muslim couples advised on ills of riding motorcycles together

PETALING JAYA: The Terengganu Religious Affairs Department (Jheat) today said it had only given a warning to the 26 unmarried Muslim couples, who were caught for travelling together on their motorcycles, respectively, during a recent sting.

Jheat chief assistant commissioner (enforcement) Nik Zulhaiza Ismail said the men and women were also given counselling before they were released.

“They were told that if they were caught doing the same ‘offence’ again, they could be arrested,” Nik Zulhaiza said, adding that such couples would be detained with the help of the Road Transport Department (JPJ) and police, as Jheat did not have such powers itself.

“We are doing this to prevent social ills in Terengganu which stem from freely mingling with the opposite sex.”

Earlier this week, Sinar Harian reported that Jheat nabbed 26 unmarried Muslim couples for riding motorcycles together.

The couples, aged between 16 and 42 years old, were arrested under Ops Bonceng last week for an “immoral act in public”.

Nik Zulhaiza went on to reveal that the department will conduct more of such operations aside from organising talks to explain the initiative to the public.

KUALA LUMPUR, Jan 18 — Under media spotlight for arresting unmarried Muslims couples riding motorcycles together, Terengganu Islamic authorities admitted today that it is considering extending the enforcement to passengers in other vehicles, such as cars.

Despite that, Terengganu Religious Affairs Department (JHEAT) said implementing the anti-vice operation dubbed Ops Bonceng for other vehicles would be different, admitting that religious officers would not be able to observe Muslims in cars.

“There are suggestions to extend [the operation] but we have to see first how Ops Bonceng is being handled,” JHEAT’s chief assistant commissioner (enforcement) Nik Zulhaiza Ismail told Malay Mail Online’s sister publication ProjekMMO.

“We cannot just implement [checking non-mahram] riding in cars together [like in Ops Bonceng] because the enforcers’ eyes cannot see what happens.”

‘Mahram’, also pronounced ‘muhrim’ in Malay, is a concept in Shariah law that refers to unmarriageable kin, such as blood relatives.

“We cannot punish and assume what they do. Unlike riding motorcycles, it is obvious that they sit together closely,” he said.

Despite that, Nik Zulhaiza said JHEAT already has provisions to act on Muslim couples who are caught together in secluded places.

“For those together alone in the car in quiet places, for example, we already have Sections 29 and 31.

“Section 29 can be used if enforcers see that the couple is already naked, while Section 31 if they are making out and so on,” he said.

KUALA TERENGGANU: Three university students and a ‘pelajar pondok’ (Islamic boarding school student) were nabbed for close proximity during a four-hour operation which began at 9pm last night. .

State Religious Affairs Department commissioner Datuk Wan Mohd Wan Ibrahim said the first couple, both aged 22 and studying in the same local university, were detained at the girl’s rented house in Gong Badak.

He said the woman was daring enough to invite her boyfriend to come over to her house as all her housemates had returned to their respective villages for holiday.

“In another case, the ‘pelajar pondok’ came all the way from Kelantan to meet his girlfriend at a rest house in Pantai Puteri.

They were partially dressed up when we stormed into their room,” he said.

The man, aged 25, and his girlfriend, aged 22, allegedly got to know each other through the social media and both had confessed for committing sexual intercourse inside the rest house.

MALACCA: The Melaka Islamic Religious Department (Jaim) detained 30 people aged 21 to 56 years, including two married women, for alleged close proximity at hotels and massage parlours in an operation from 11.30pm last night.

Jaim Enforcement Division principal assistant director Rahimin Bani said nine men were detained at four massage joints while 21 others (10 men and 11 women) were caught at seven budget hotels in Melaka Tengah.

Young imam jailed for khalwat

IN an ironic turn of events, a young imam and an Islamic Affairs officer were sentenced to 14 days’ jail and fined RM2,900 by the Gombak Timur District Syariah Lower Court for committing khalwat (close proximity), reported Kosmo!.

The sentences was meted by judge Shaiful Azli Jamaludin after Mohd Noruddin Salam Naluwi, 29, and Siti Khadijah Md Ghazali, 27, pleaded guilty to the offence.

Mohd Noruddin and Siti Khadijah admitted committing khalwat at a house in Taman Melawati at 3.30am on July 30.

A team of enforcement officers from the Selangor Islamic Religious Department (Jais) raided the house after receiving a complaint from the public about an unmarried couple staying in the house.

During the raid, the officers found Siti Khadijah sleeping in a bed that was also shared by Mohd Noruddin.

Mohd Noruddin is an imam at a mosque in Taman Melawati and a widower with two kids. Siti Khadijah, who is unmarried, is an Islamic Affairs officer with a public university.

PETALING JAYA: The way Malaysian religious authorities are policing khalwat (close proximity) is beyond anything in Saudi Arabia or other Gulf States today, warns a leading NGO.

G25 adviser Mohd Sheriff Kassim points out that even Saudi Arabia, the country which is home to Islam’s holiest site, has issued stern guidelines to limit the powers of the moral police to harass and arrest Muslims.

“The instruction is that the moral police should not take the law into their own hands and instead, it should advise those committing offences under the morality laws to change and repent,” he said In a statement today.

His comments were in response to the recent death and injuries of two policemen who jumped from buildings to escape raids by the Selangor Islamic Religious Department (Jais).

Hotels cannot stop raids by religious authorities, says spokesman

PETALING JAYA: Hotels are obligated to comply with religious authorities during khalwat (close proximity) raids, but cannot disclose the personal information of guests, including which rooms they are in, according to the Malaysian Association of Hotels (MAH).

Speaking to FMT, MAH president Cheah Swee Hee said hotels had to comply with the religious authorities when the latter carried out a raid on a room.

“We cannot obstruct them from carrying out their duties.

“Also, the religious authorities are usually acting on tip-offs of something taking place in a specific room,” he said, referring to the issue of khalwat raids.

The issue has been highlighted again following the death of a policeman who had leapt to his death in a bid to escape a raid by religious authorities recently.

Cheah said the raiding party would then inform the hotel management which room they intended to raid and the hotel security would only escort them to the room.

“The religious authorities would then knock on the door and ask to be let in, and more often than not, the guests would comply. Hotels are not allowed to open the door for the religious authorities.”

However, Cheah stressed that hotels were also bound by the Personal Data Protection Act 2010 (PDPA) to protect the personal information of guests.

“This means that religious authorities cannot ask the hotels who is staying in a certain room or which room is a person staying in. We cannot disclose such information.

“The religious authorities also cannot go knocking door to door,” Cheah said.

Man claims robbery after paying for sex

A 70-year-old Felda settler’s infidelity was exposed – thanks to the police who investigated his false report that he was robbed of RM500 by a woman, reported Kosmo!

The man, from a Felda settlement near Jempol, had lodged a report on Nov 24, stating that he was robbed at knife point by a woman.

Jempol police brought him in for questioning after finding the woman who allegedly robbed him.

Jempol OCPD Supt Noorzainy Mohd Noor said investigations revealed that the man had paid RM500 to the 26-year-old woman after having sex with her in a hotel in Bahau that day.

He said the woman claimed she charged the man RM100 for her services but he had then paid her RM500 by mistake.

He said the man had made the false report to hide what he had done from his wife.

Khalwat: A shame that can kill

Some see the offence as more scandalous than corruption or murder, says an activist lawyer.

PETALING JAYA: Social activist and lawyer Azhar Harun blames shame for a recent death associated with a khalwat raid.

He said although the punishment for khalwat was “not that bad”, the stigma attached to those found guilty of the offence could destroy them.

“They get their pictures posted all over the newspapers, tabloids, magazines and 999 (a television series on TV3),” he said. “This has been going on for a very long time.”

Azhar, also known as Art Harun, said he believed that some Malaysians saw khalwat as more scandalous than even crimes that are universally considered as heinous.

“If you get caught for theft, your reputation is still okay,” he said.

“Being caught for khalwat is considered even more shameful than being caught for corruption or even murder.

“Even if you get caught for rape but then marry the victim, you are still all right, but God forbid that you should get caught for khalwat. Your life is gone, man.”

He said this was the reason people were willing to risk life and limb to escape being caught for khalwat.

It did not help that khalwat raids were usually conducted in the early hours of the morning, he added.

“The raids are usually around 3am or 4am at apartments or hotels. These people are awakened with a shock. It is in such a state – and in the darkness – that they try to run from their rooms on the higher floors. That’s when they end up falling to their deaths.”

According to a Berita Harian report, a policeman died at 3am yesterday after he jumped from the fourth floor of an apartment in Cheras in a bid to escape a khalwat raid by the Selangor Islamic Religious Department (Jais).

In Puchong Perdana, another policeman was hurt after he too tried to escape a raid by Jais. He is said to be in critical condition.

Cop dies, another hurt in JAIS raids

A police personnel died while another was hurt when they were trying to avoid being caught for khalwat (close proximity) in two separate raids by the Selangor Islamic Affairs Department.

Berita Harian reported Jais officers found the Bukit Jalil police personnel unconcious at the bottom of a condominium unit when they raided a fourth-floor apartment unit at Pandan Perdana, Selangor at about 3am today.

A woman who was at the apartment said he was her lover, the daily reported.

He was rushed to the Ampang Hospital but succumbed to injuries at 6.45am, it reported.

In a separate incident in Taman Puchong, a police officer was reported to have jumped out of an apartment to flee a Jais raid.

He is in critical condition, Berita Harian reported.

Gagal masuk bilik, Jais anggap siasatan khalwat Faye tak lengkap

KUALA LUMPUR, 31 Ogos — Jabatan Agama Islam Selangor (Jais) mendedahkan serbuan ke rumah keluarga pelakon Faye Kusairi, April lalu, tidak mampu mengikut prosedur sepenuhnya.

Pengarah Jais Datuk Haris Kasim berkata serbuan tersebut sudah mengikut tatacara operasi piawai (SOP) kecuali pengawai penguatkuasa gagal memeriksa sebuah bilik di rumah berkenaan.

“Pihak penguatkuasa sudah menjalankan tugas seperti SOP yang sepatutnya,” katanya kepada ProjekMMO.

“Cuma kegagalan mereka memasuki satu bilik atas alasan yang diberi oleh keluarga Faye menyebabkan mereka gagal mematuhi SOP selanjutnya.

“Kalau dari proses perundangan, kesalahan penguatkuasa ialah tidak melengkapkan siasatan dengan mengabaikan siasatan terhadap satu bilik lagi.”

ProjekMMO difahamkan bapa Faye enggan membenarkan Jais memeriksa biliknya kerana dibimbangi mengganggu isteri yang mengidap penyakit darah tinggi.

April lalu, Faye mendakwa unit kondominium dupleks keluarganya di Bukit Antarbangsa dekat Ampang diserbu selepas Jais menerima aduan bahawa beliau berkhalwat dengan suami orang.

Dalam kejadian 2 pagi itu, Faye yang tiada di rumah, mendakwa anggota Jais memotong mangga jeriji pintu masuk sebelum mengejutkan adiknya yang sedang tidur.

Mei lalu beliau berkata Jais sudah membaiki kerosakan jeriji di pintu rumahnya, namun tindakan saman masih dipertimbangkan bagi mengelak kejadian sama berulang.

“Mereka sudah betulkan pintu dan saya masih menunggu laporan siasatan. Saya dengar kosnya RM2,000 hanya untuk pemasangan sahaja kerana pintu itu perlu ditempah.”

Haris semalam berkata laporan siasatan kes berkenaan sudah diserahkan kepada peguam Faye dua minggu lalu, namun pelakon drama “Pujaan Hati Umi” belum mendapat salinannya.

Pelakon dan pelawak berkenaan menjawab dakwaan orang ramai di laman sosial yang mengaitkan isterinya, Zila atau Nur Azilah Seeron, 28, wanita yang ditangkap khalwat bersama teman lelakinya.

Ketika kejadian, wanita itu yang juga penyanyi ditahan sepasukan penguat kuasa Jabatan Agama Islam Wilayah Persekutuan (JAWI) dan ditemui bersembunyi di belakang almari di dalam bilik apartmen teman lelakinya di Bukit Jalil, dekat sini, awal pagi kelmarin.

Dalam pada itu, Along berkata, perceraian bersama isterinya masih lagi dalam proses.

BANDA ACEH — Eighteen people were publicly caned on Tuesday (March 1) for breaking Islamic law in Indonesia’s Aceh province, including a young unmarried couple who were caught spending time alone together.

A hooded man meted out lashings with a rattan cane on a stage next to the mosque in Banda Aceh, the capital of the western province, in front of a large, cheering crowd.

A 19-year-old woman and a 21-year-old man were caned eight times each after they were found spending time alone together, which is against the law for unmarried Muslim couples in the province.

Public caning happens on a regular basis in Aceh, the only province in the world’s most populous Muslim-majority country to implement Islamic sharia law, but is less common for women.

Six young men were also caned 40 times each after they were caught drinking alcohol, which violates Islamic law, at a birthday party in a hotel room in December.

Authorities did not disclose the offences committed by the rest of the group, who were all men.

MELAKA: A 15-year-old schoolgirl and her 22-year-old boyfriend were among four couples detained in an operation by Jaim, the Islamic affairs department, early today.

Jaim director Ismail Hamid said the girl, a Form Three pupil from Masjid Tanah, Alor Gajah, and her partner were detained in a room of a budget hotel in Jalan Tun Ali at 2.50 am.

“Jaim will inform her parents and the school authority,” he told reporters here today.

KUALA LUMPUR, Dec 25 — It was the nightmare before Christmas for Muslim Wan Saiful Wan Jan, who claimed to have been rudely woken up at 3.20am yesterday by a group of Islamic religious officers on an “inspection” of a hotel in Parit Buntar, Perak.

The chief executive of think tank Institute for Democracy and Economic Affairs accused the district Islamic religious office of allegedly violating his privacy in the early morning check of the room he shared with his mother, by a group of six to seven male officers.

“I think it’s really unfair, this kind of moral policing,” he told Malay Mail Online when contacted today.

PETALING JAYA: Institute for Democracy and Economic Affairs (Ideas) chief executive officer Wan Saiful Wan Jan has lashed out at “religious officers” for “checking” his hotel room supposedly for khalwat (close proximity) activities.

Calling the raid “stupid,” Wan Saiful said he had checked into the budget hotel with his mother in Parit Buntar, Perak, on Wednesday night.

Several hours later, he said a group of men claiming to be from the Islamic religious department knocked loudly on his door at about 3.20am Thursday.

After they showed me their name cards, they insisted on coming into the room, supposedly to conduct a ‘check’, even though I told them my mother was asleep.

“As it is, they were disturbing us at an ungodly hour, plus they had no regard for our privacy,” he explained in a Facebook post.

I just checked with the hotel. The pejabat agama people raided 3 rooms, all room number ending with 8. Mine was 308. Stupid. This is one of the officers apparently.

Khalid tells Jais to explain khalwat bungle on Monday

SHAH ALAM, July 5 ― The Selangor Islamic Affairs Department (Jais) has been ordered to explain itself over allegations that it wrongfully detained four Malay Muslims on the charge of khalwat or close proximity late last month.

Selangor Mentri Besar Tan Sri Khalid Ibrahim said he expects Jais to issue a statement on Monday to clarify what happened in the June 22 incident in Salak Tinggi, Selangor.

“There are some things that did not follow proper procedure. The process must be done properly and if it is not right, we correct it… I hope Jais will learn from this,” he said at a news conference here today.

Yesterday, the four complainants accused Jais officers of abusing their powers by arresting them while they were in the midst of shifting furniture into their newly-rented home.

They claimed that two Jais officers had approached them and allegedly cited them for khalwat because their male friend, in his 20s, was alone with three women.

Khalid today said that he has ordered Jais to report to him and his executive council if they plan to carry out operations that will involve non-Muslims, but the religious department has full autonomy to conduct operations without having to inform him if it is on Muslims.

“However, we will need to look at the issue of procedures,” he said.

The eldest of the women, 29-year old Hanisha Abdul Rahman, told reporters that Jais officials had overreacted but refused to back down when questioned.

Latheefa said the four want the Jais officers to apologise or face legal action.

“We have been instructed to inform Jais, failing which we have been given instructions to proceed to sue them,” she added.

PETALING JAYA, July 4 — Three women and one man accused today officers from the Selangor Islamic Affairs Department (Jais) of abusing their powers, as they highlighted their arrest for khalwat (close proximity) last month while moving house.

At a news conference today, the Malay Muslim foursome shared their distress at the hands of the Islamic religious law enforcers through their lawyer, Latheefa Koya, saying they were nabbed while in the midst of shifting furniture into their newly-rented home in Salak Tinggi, Selangor on June 22.

Two Jais officers approached them and allegedly cited them for khalwat because their male friend, in his 20s, was alone with the three women, they related.

Khalwat means close proximity between an unmarried male and female Muslim suspected of engaging in immoral activity in an enclosed surrounding.

“This is just too easy,” Latheefa, who is with legal rights group Lawyers for Liberty, told a press conference here.

She claimed the man friend was not inside the house when the incident took place, but outside in the compound where he could be seen helping the women carry their belongings.

“Males and females can be within close proximity in any circumstances but that does not mean they are doing anything immoral.

“You can find yourself in this situation all the time. Too many a time that this khalwat arrest has been subjected to abuse,” the lawyer said.

In screw-up, house-shifters held for ‘khalwat’

Three women and a man want the Selangor Islamic Affairs Department (Jais) punished for wrongly arresting them and demanding money for khalwat (close proximity), when they were merely moving house.

Lawyers for Liberty’s Latheefa Koya said the four, aged between 20 and 29 years, were arrested by two Jais officers around noon on June 22.

At that time, the man was helping the women shift furniture into their newly-rented house in Salak Tinggi, Selangor.

The man was outside and the women were all inside the house.

Following the incident, the women made a police report against Jais officials on Monday.

She said that after the arrests, Jais merely sent the women a letter asking them to turn up at the Syariah Court on Dec 17 with RM3,000 each, the maximum fine allowed for khalwat.

It is not clear whether the four would be charged or face trial, Latheefa said.

Latheefa said that although Jais commonly arrests Muslims for khalwat, many victims have preferred to keep quiet, rather than speak up because of shame and embarrassment associated with the charges.

In this case, however, the women want to clear their names as there was absolutely no wrongdoing on their part.

Jais in the spotlight over arrest of four in Salak Tinggi

PETALING JAYA: The Selangor State Religious Department (Jais) is being accused of wrongfully nabbing four people for khalwat (close proximity) last month.

The incident, which involved Hanisha Abdul Rahman, 29, and Muhammad Mukamil Nordin, 22, occurred at midnight on June 22, outside the former’s house in Salak Tinggi.

Also caught for close proximity were two students living in the same house, aged 19 and 21.

Hanisha, who works at a shop in KLIA2, claims to have known Muhd Mukamil from work, as he is an airport limousine driver and sends her to and from work.

“He is our driver,” Hanisha told reporters at a press conference here on Friday, adding that Jais had claimed in their report that the four were caught in the house although Muhd Mukamil had been outside the place after dropping Hanisha off.

“My dignity and good name have been called into question,” she said.
