KUALA LUMPUR: Some politicians from Barisan Nasional thought money would end the ordeal Teoh Beng Hock’s family was going through as a result of his mysterious death, according to his sister, Lee Lan.

When the government agreed, in 2015, to pay the family RM600,000 in compensation, many people, including ruling politicians, saw the case as solved and wondered why the family was still insisting on the continuation of police investigations, Lee Lan told FMT.

“People didn’t understand why we needed to continue to pursue the case in a criminal court,” she said. “It didn’t help that there were several politicians who told reporters that the outcome of our civil suit meant that the case was solved.

“We even had strangers coming up to us to ask my mother why were we still pursuing the case when we had already got our payment.”

After the Court of Appeal ruled in 2011 that Beng Hock’s death was “accelerated by unlawful acts” committed by Malaysian Anti-Corruption Commission (MACC) officers, the family decided to file a civil suit alleging negligence and assault leading to death. Named as respondents were the government of Malaysia, 10 MACC officers and the commission itself.

It was in order to settle the suit that the government paid the compensation.

Lee Lan said the family accepted the settlement because it meant the government was acknowledging that Beng Hock died as a result of wrongdoing on MACC’s part. Indeed, she added, the civil suit was filed in order to challenge the theory that he committed suicide.

Now that the criminal case is being reopened, Lee Lan and DAP, of which Beng Hock was a member, have called for the suspension of five MACC officers said to have been implicated in the case. They have been named in several reports as Hishamuddin Hashim, Hairul Ilham Hamzah, Mohd Anuar Ismail, Mohd Ashraf Mohd Yusuf and Zulkefly Aziz.

Three of them – Hishamuddin, Anuar and Ashraf – were castigated by a royal commission set up in 2011 to inquire into the circumstances of Beng Hock’s death. But the attorney-general cleared them of criminal charges in 2012.

Lee Lan noted that Hishamuddin had since been promoted and given a new assignment in Sabah.

I would like to announce that the Attorney General’s Chambers has requested Inspector General of Police, Tan Sri Dato’ Sri Mohamad Fuzi Harun to carry out further investigations into the death of Teoh Beng Hock as it is of the view that such investigations are necessary in light of the Court of Appeal’s finding that other unknown personalities, including MACC officers were involved in Teoh’s death.

This was after I had, through my firm Messrs Karpal Singh & Co, acting as solicitors for Teoh’s family, written to the said Attorney General’s Chambers letter dated 6.6.2018 pertaining to whether Teoh’s death would be investigated further.

I can confirm that the said Attorney General’s Chambers has written to the IGP letter dated 17.7.2018, a copy of which was extended to my firm, requesting for further investigations to be commenced into Teoh’s death.

I am of the view that the above is a positive development in the matter and hope that such investigations reveal those responsible for Teoh’s death especially since the Court of Appeal has made a finding that there were others involved in the same.

I will, no doubt, continue pressing the authorities for updates on the matter periodically as I am firmly of the view that justice must be done in Teoh’s case.

PM agrees to re-investigate Beng Hock’s death

Prime Minister Dr Mahathir has agreed to re-open investigations into the death of former DAP political aide Teoh Beng Hock, according to sources.

Finance Minister Lim Guan Eng, who is also DAP secretary-general, is expected to hold a press conference on this matter.

On July 16, 2009, Teoh was found dead after falling nine floors from MACC’s previous Selangor headquarters in Shah Alam, where he had been held overnight for questioning.

At the time, the deceased was the political aide to then Seri Kembangan assemblyperson Ean Yong Hian Wah.

In 2014, the Court of Appeal overturned the coroner’s open verdict with regard to Teoh’s death, ruling instead that the latter died from a fall that could have been accelerated by unlawful actions of persons unknown, including by MACC officers.

Following the verdict, MACC agreed to pay RM600,000 to Teoh’s family to settle a negligence suit they brought against the commission.

The court also ordered the police to investigate the death.

However, the Attorney-General’s Chambers found no criminal elements in his death.

Pakatan Harapan had pledged to investigate Teoh’s case by setting up a Royal Commission of Inquiry (RCI) in the first 100 days of the coalition taking over the government.

The DAP veteran says cases of injustice resulting in death should be re-opened, and notes the double standards in Umno’s stand on Najib Razak’s questioning by MACC.

KUALA LUMPUR: DAP strongman Lim Kit Siang today called for cases of injustice resulting in death to be reopened, including that of Teoh Beng Hock.

He noted that acting Umno president Ahmad Zahid Hamidi had said that all quarters should respect the Malaysian Anti-Corruption Commission (MACC) probe against Najib, as long as it was conducted “within the appropriate hours”.

“If this rule had been strictly observed, Teoh Beng Hock would not have died at the Selangor MACC premises in Shah Alam on July 16, 2009, and still be awaiting justice nearly nine years later – the reason why the Teoh Beng Hock case, like many other cases of injustices resulting in death, should be re-opened for justice to be finally done,” he said.

Teoh, who was a journalist and a political aide to DAP assemblyman Ean Yong Hian Wah, was found dead on July 16, 2009, having fallen from a window of the MACC office in Shah Alam after being taken there for questioning the night before.

No criminal element in Teoh Beng Hock’s death, says Nancy

The Attorney-General’s Chambers found no criminal element involved in the death of political aide Teoh Beng Hock in July 2009 after examining the report of the police’s special task force.

This was revealed by Minister in the Prime Minister’s Department Nancy Shukri in a written parliamentary reply yesterday.

“After studying and scrutinising further the investigation paper and the special task force paper, the AG’s Chambers found that no crime committed by any officer of Malaysia Anti-Corruption Commission (MACC),” Nancy said.

She was referring to a new investigation conducted by the police following the Court of Appeal’s decision to overturn the coroner’s open verdict in Teoh’s death.

Teo Nie Ching (DAP-Kulai) had asked for the outcome of the new investigation which was carried out by a special task force set up by the police.

The Court of Appeal had in 2014 unanimously overturned the coroner’s open verdict following a lengthy inquest into the death of Teoh.

“The death of Teoh Beng Hock was caused by multiple injuries from a fall from the 14th floor of Plaza Masalam as a result of, or which, was accelerated by an unlawful act or acts of persons unknown, inclusive of the MACC officers who were involved in the arrest and investigations of the deceased,” the court said.

PETALING JAYA (THE STAR/ASIA NEWS NETWORK) – The police have reopened investigations into the 2009 death of Mr Teoh Beng Hock, the political secretary to Selangor executive councillor Ean Yong Hian Wah, said Inspector-General of Police Khalid Abu Bakar.

Mr Teoh was found dead on July 16, 2009, on the fifth-floor corridor of Plaza Masalam in Shah Alam after he had given a statement at the office of the Selangor branch of the commission on the 14th floor of the building.

“Following from the Court of Appeal decision of Sept 5, 2014, the Royal Malaysian Police immediately reopened investigations with a special team set up on the instructions of the Attorney-General’s Chambers. A complete investigation is still ongoing and the Royal Malaysian Police are in no way ignoring the Court of Appeal’s orders,” said Tan Sri Khalid in a statement on Monday.

More than 40 people, including MPs from DAP, protested at Parliament gate, urging Prime Minister Najib Abdul Razak to walk his talk, and punish those responsible for the death of Teoh Beng Hock.

They also held pictures of the three MACC officials who were allegedly involved in the death of the former political aide, saying they are now “wanted”.

They are former Selangor MACC investigations unit head Hishamuddin Hashim, investigation officer Mohd Anuar Ismail and assistant superintendent Mohd Ashraf Mohd Yunus.

Teoh Beng Hock’s parents, namely Teoh Leong Hwee and Teng Shuw Hor, were also present.

The Malaysian Anti-Corruption Commission (MACC) officer, who headed a controversial investigation that led to the death of political aide Teoh Beng Hock, has been promoted.

According to a parliamentary written reply, Minister in the Prime Minister’s Department Paul Low said Mohd Anuar Ismail, who was a Grade 44 investigation officer during the incident in 2009, is now Grade 48.

However, two other MACC officers involved in the probe, Hishammuddin Hashim and Mohd Ashraf Mohd Yunus, remain at the same ranks  – Grade 54 and Grade 29 – respectively.

It made no mention when the promotion took place.

The reply was in response to a query by Kulai MP Teo Nie Ching, who requested for the current status of the three officers.

Hishammuddin and Ashraf were singled out by a royal commission of inquiry into Teoh’s death for their role in interrogating the political aide, labelling them “arrogant leader” and “abuser” respectively.

A third officer, Arman Alies was also labelled as a “bully” by the commission.

However, the parliamentary written reply today made no reference to Arman as his name was not raised in Teo’s question.

Cops to re-open Teoh Beng Hock case

 KUALA LUMPUR: Bukit Aman will re-open the Teoh Beng Hock case following the Court of Appeal’s landmark judgement in setting aside the coroner’s open verdict in the original inquest.

Federal CID director Comm Datuk Seri Mohmad Salleh said the police would re-investigate the case, where the initial findings ruled Teoh’s death as sudden death.

“If there is a need then we will call more witness.

“We want to investigate the possibility that his death was a result of, or was accelerated by, persons unknown,” he told a press conference at the Police Training Centre (Pulapol) here on Friday.

Court overturns open verdict on Beng Hock

The Court of Appeal in Putrajaya today unanimously overturned the coroner’s open verdict following the inquest into the death of DAP political aide Teoh Beng Hock.

Due to the importance of the case, the court has written three separate judgments on its decision.

Justice Mah Weng Kwai was the first to read his judgment. The other two who sat with him and who will also read out their decisions are Justice Mohamad Ariff Md Yusof and Hamid Sultan Abu Backer.

Court of Appeal judge Justice Dr Hamid Sultan Abu Backer, who read out a separate judgment, directed the Inspector-General of Police and Attorney General’s Chambers to commence investigation under the Criminal Procedure Code (CPC) and prefer appropriate charges as they deem fit.

Open verdict in Teoh Beng Hock inquest overturned, suicide ruled out

PUTRAJAYA: In a landmark judgment, the Court of Appeal has set aside the coroner’s open verdict in the inquest of Teoh Beng Hock.

In a unanimous decision on Friday, the panel held that Teoh’s death was caused by multiple injuries from a fall from the 14th floor of Plaza Masalam as a result of, or which was accelerated by an unlawful act or acts of persons unknown, inclusive of Malaysian Anti-Corruption Commission (MACC) officers who were involved in his arrest and investigation.

Court of Appeal judge Justice Mohamad Ariff Md Yusof, who chaired a three-man panel, allowed the appeal by Teoh’s brother, Teoh Meng Kee, against the decision of the Shah Alam High Court which had on Dec 1, 2011 dismissed their application for a revision into Teoh’s inquest and upheld a coroner’s open verdict.

Justice Mohamad Ariff said the interest of the family members and the public requires that the case be further investigated by the police.

“This further investigation should include a more thorough examination of the alleged suicide note by a handwriting expert with a clear expertise in Chinese handwriting and with sufficient copies of the deceased’s original sample handwriting be made available,” he said.

Justice Mah Weng Kwai, reading one of the three judgments, said that the open verdict in the inquest was incorrect, ruling out that the political aide had committed suicide.

He said that the correct and proper verdict to be returned in the inquiry is one of death caused by person or persons unknown.

“Every effort must be made to track down the perpetrator or perpetrators in a thorough police investigation. No one should be spared in the investigations so that there will be no allegations of a cover up,” Justice Mah said.

He added that it was incumbent on the magistrate in the inquiry of death to have treated Teoh’s death as a “custodial death”.
