Student faces action over anti-GST Facebook post

A UiTM student is facing disciplinary action for a Facebook posting purportedly against the goods and services tax (GST).
In a letter dated April 28, the university stated that Mohd Fathihie Gadius of UiTM’s Sabah campus is charged with breaching Educational Institutions (Discipline) Act 1976.
He is charged with “making a public statement via social media website Facebook which can encourage acts which breach the code of conduct, cause disruption (and) defiance” among UiTM Sabah students.
The biology undergraduate is also charged with committing a similar offence through more than 20 postings from October 2013 to January this year.
If found guilty, he can be suspended from university and not allowed to enter the campus.

Shorts and Gen Y at anti-GST rally

The first big rally I covered as a journalist was in 2010. It was the second Bersih rally, and my colleagues and I stayed overnight near Medan Tuanku], forced to do so by road closures and a police all-out clampdown.
The picture of demonstrators filling up Jalan Tun Perak on July 9 that year is still my mobile phone wallpaper and looking at it today, a few things jumped out at me.
Most, if not all in the photograph, were in long pants, many in long sleeves, with towels or handkerchiefs tied across their faces, carrying backpacks of anti-tear gas supplies – toothpaste, salt, bottles of water.
The women were dressed about the same, with many in long tudungs. Others were in combat pants and boots, some had brought along gas masks.
No one was in a short skirt or even sandals for obvious reasons. No one wants to risk being groped or trampled, or worse still, having your skin actually touched on the lock-up floor if hauled up.
Fast forward to 2014 and it almost feels like a different place altogether.
Amid the throng of people at the anti-goods and services tax rally on Thursday was a place for short skirts and faux Chanel handbags, for men in pressed chinos and polo shirts, elderly couples looking as though they were going to a wedding or young families going on a weekend outing.
This was not the first time I was noticing such a phenomenon. Stuck in traffic en route the first post 13th general election rally in Kelana Jaya, I could not help but spot young girls in hot pants running towards the stadium in their platform sandals.
Beyond amazement of how one could run in platform sandals, I wondered: Who are these people, and why, unlike their counterparts in 2010, aren’t they ready to do battle?
I spoke to a few at Thursday’s rally to find out.
Carmen and friend, 20s, “labour”
We’re here because the GST will bring prices up higher because it is a consumption tax. We will have to pay for it all, not the businessmen who get to claim back the tax paid (in the production line).
We are labour, and this is labour day. Our salaries have not go up, we want the government to hear us.
(When asked why they are dressed like they’re going for a beach party:)
We don’t care. We don’t care about what they will do to us. We don’t care if the police does anything to us, as long as this would help cancel the GST.

Rais wants action taken against students at protest

Firm action should be taken against university students who took part in a rally protesting against the Goods and Services Tax (GST) on Thursday.
Social Affairs and Culture Adviser to the Government Rais Yatim said the students should realise they were flouting the law which was passed in Parliament.

IT IS BECAUSE THEY WILL BE THE HARDEST HIT BY THE GST.
*Among them are civil servants whom the CUEPACS President accuse of being ‘traitors’ of the government. HE IS WELL PAID AND ENJOYS MANY BENEFITS. When he retires, presumably with a datukship, he can expect large contracts if he goes into business, or he will be an UMNO BIG SHOT.
*Among them are the ordinary folks whom BN-Gerakan man Tan Keng Liang mocked for bringing their children along to the Rally.


Tan Keng Liang, apart from being a politician, is a LAWYER! Do you know many poor lawyers? He can afford to leave his kids at his luxurious mansion with a couple of maids when he goes out.

Especially since the government has failed to account for all the leakages (just look at each year’s Auditor-General’s Report), corruption (RM250 million to National Feedlot Corporation, ‘fees’ for Scorpene submarines and too numerous to list here) and wastage.

Cops: No injuries, stabbing at ant-GST rally
None of the participants at the gathering to protest the Goods and Services Tax (GST) was injured or stabbed as claimed by some quarters on the Internet, said Dang Wangi district police chief ACP Zainuddin Ahmad.
He said a picture, allegedly sent on Papagomo’s Twitter, showing a participant lying on stretcher with a caption saying that a member of the PAS’ Amal Unit who was involved in a fight with SAMM was stabbed and died was an old photograph.
On a claim that there media photographers were injured while covering the gathering, Zainuddin said the police had yet to receive any report on the matter.

JITRA: Public servants involved in the protests against the Goods and Services Tax (GST) at Dataran Merdeka in Kuala Lumpur on Thursday could be considered as traitors to the government.
Cuepacs president Azih Muda said they do not deserve to be called civil servants. He added that civil servants involved in the gathering had violated the “Akujanji” and service pledge that they had made.

Scuffle breaks out at GST rally as group tries to force way into Dataran Merdeka
SAMM members and Unit Amal members scuffle as the former tried to get into Dataran Merdeka
KUALA LUMPUR: A scuffle broke out between a group Solidariti Anak Muda Malaysia (SAMM) members and Unit Amal officers on Jalan Raja, near Panggung Bandaraya as the former group tried to force their way into Dataran Merdeka.
Unit Amal members could be seen trying to hold the line while the crowd pushed forward, throwing water bottles and engaging in a brawl with members of Jingga 13, who tried to calm them down.

Unit Amal officers quickly brought the situation under control.
SAMM coordinator Badrul Hisham Shaharin, popularly known as Chegubard, apologised on behalf of those involved in the scuffle and said he would look into the matter.
“If there really were SAMM people causing harm, I apologise,” he said.
He said those wearing SAMM T-shirts were not necessarily from the group as the garments could be bought anywhere.
However, Chegubard acknowledged that a group of people dressed in SAMM T-shirts entered Jalan Raja at around 4pm amidst a cloud of orange smoke.

Over 50k throng anti-GST May Day rally
4:30pm – Opposition Leader Anwar Ibrahim takes to the stage, and true to his famed oratory skills, works the crowd.
He shares a personal story about how his international friends urged him to stay back in London when he visited recently.
“But I told them no! I will come back to Malaysia to fight!” he says.
Anwar tells the crowd that they should not have to wait for the next general election for change but to press for reformation of the system now.
“We as the leaders, we want to listen to the voices among ourselves or the voices of the people? Definitely the voice of the people to stand up to fight against the oppressive economic system,” he says.
Anwar also asks the crowd to salute Mohammad Sabu as the “rally king” and promises that assemblies like this will be repeated until the government stops its cruelty.
“Don’t let this be the last assembly, ya Allah. Let the people bravely rise up against injustice,” he adds as he then leads the crowd in prayer.
The rally ends.
As people begin to depart, PAS’ Jabatan Amal members are seen helping to clear the rubbish, roping in children to help.
4.10pm: Dataran Merdeka – PAS central committee member Dzulkifli Ahmad takes the stage, saying: “With the GST, the government can earn RM20 billion, where is it from? From the sea? From the sky? From the trees?
“Of course from the people.”
4.05pm: Jalan Raja – A brief scuffle involving a group of black-clad youths breaks out here.
The exact reasons for the clash are unclear, but Unit Amal members move in quickly to isolate the group from the rest of the crowd.
The situation is defused five minutes later following talks between one Unit Amal member and one of the youth involved in the scuffle.

3.30pm: PAS deputy president Mohamad Sabu slams the introduction of GST by the BN government and comments on the missing MAS flight MH370.
He says the reason the government wants to implement GST because it cannot tackle the issue of corruption, leakages and abuse of power.
“Don’t let your failures of government cause the people to be punished. We are truly suffering. Enough of this now,” he says.
“Under their administration, not only (Mongolian interpreter) Altantunya Shaariibuu went missing, the jetplane has also gone missing, even the flight is also missing.
“This shows the failure of governance in Malaysia,” he says.
3:23pm: Youth activist Adam Adli gets rousing support as he goes up to speak from the lorry. The sky turns dark as grey clouds gather, threatening rain.
“We did not come here to sit down or to take some nice pictures for Facebook alone right?
“This is a show of force to the government that the rakyat still have the power.
“The rain is coming. If before it was chemical rain from FRU, this is good rain…
“We are giving a warning to the government: We are not afraid of you – we can bring you down even without waiting for an election.”
3.15pm: Lawyers For Liberty (LFL) commends the police for facilitating a people’s assembly.
“So far so good, the police are facilitating the May Day anti-GST rally – this should be the norm rather than exception,” reads one tweet.
“What a rare sight! The police stopping traffic for the rakyat! Syabas (congratulations) for facilitating the right to assembly,” reads another LFL tweet.
3.15pm: There are no reports of any casualties so far, says Gengta Tan, a member of the medical team at the rally.
He says there is a team of 37 doctors and 20 nurses, paramedics and emergency responders ready to act should there be any injuries.
They also have 11 automatic external defibrillators (for reviving heart attack patients) and seven ambulances on standby.
“If anything happens here, it will be sent to the nearest hospital, which is Hospital Kuala Lumpur or Tong Shin Hospital,” he told Malaysiakini.

Anti-GST rally sees 10,000 hit the streets

2.25pm: The crowds gathered in the city at the various points are now estimated at 10,000 in total.
2.16pm: Dataran Merdeka – Police hold the crowds at both ends of Dataran Merdeka, keeping the 6-lane street across Bangunan Sultan Abdul Samad empty. Thousands have assembled at both ends, eager to occupy the space, shouting and cheering. A helicopter is seen circling above.
Although the participants have pass through the blockade, they are stopped by PAS Unit Amal at the junction between Jalan Raja and Jalan Mahkamah Persekutuan.
“Let’s do it in stages,” a Unit Amal personnel tells Malaysiakini referring to how the participants will eventually occupy the whole Jalan Raja.
They are waiting for participants from other gathering points to reach this final destination of the rally.
There are over one hundred police personnel present but they have done nothing to stop the crowd.
Meanwhile, Suhakam commissioner James Nayagam is happy that the rally is peaceful so far.
“This is what we encourage, this is freedom of assembly,” he says when interviewed by reporters at the sidelines of Dataran Merdeka.
2pm: KLCC Jalan Ampang entrance – The crowd listens to speeches from several NGO representatives such as student leader Mohd Bukhairy Sufian and anti-Lynas activist Wong Tack.
KLCC security guard the mall entrance and watch the proceedings and are seen preventing anyone with anti-GST headbands or flags from entering.
1.45pm: Masjid Negara – After zohor prayers thousands listen to speeches by Pakatan Rakyat leaders like Hatta Ramli, Saifuddin Nasution, Khalid Samad, Suhaizan Kaiat, Anuar Tahir.
They are speaking from a lorry prepared by PAS. The crowd here estimates 5,000.
PAS Youth election director Mohd Sani Hamzan warns if the government implements GST and signs the TPPA, the country will finish off BN.
“Wait for the moment of BN’s demise in GE14,” he says, to chants of “Down with BN, reject BN!”
Hatta in his speech says Pakatan has continuously argued against GST but it is still being implemented.

Anti-GST rally: Pay your own debts, gov’t told
1:20pm; Dataran Merdeka – The marching comes to a halt after a brief 10 minute walk from Sogo as they arrive. To avoid the scorching sun, they crowd around sheltered areas, under big trees and traffic dividers under the LRT tracks waiting for more to arrive, watching traffic go by.
Only Unit Amal members dressed in vermillion long-sleeved shirts and dark pants take advantage of the break to perform their afternoon prayers, prostrating and standing in orderly lines.
They also form a blockade to prevent people from entering Jalan Raja ahead of the event starting at 2pm.
1.12pm: Dataran Merdeka – A government servant tells Malaysiakini he is determined to participate in the rally.
The father of three, who only wants to be known as Hisham, is here with his entire family all dressed in red.
They came down from Perlis yesterday.
“This is not a matter of being a government servant. Government servants are also affected by GST.
“If only my wife and I participate in this event, then in the future our kids will suspect us of supporting GST.
“If we only tell them about this in future, they would not be able to witness this. So we want to give them a chance to remember this,” he tells Malaysiakini.

Anti-GST rally: Pay your own debts, gov’t told

12:45 pm: Sogo – Three busloads of young PAS supporters from Kuala Terengganu have come to protest the GST.
About 20 of them are here, holding out flags and banners and wearing green headbands. Some wear white songkoks. They are all from one kampung, Batu Enam in Kuala Terengganu. The protestors say they want to ask PM Najib Razak’s government, “Why are you burdening us?”
12:30pm: The crowd is swelling outside Sogo, vuvuzelas consistently blasting away. From across the street, it looks like it is bleeding red on the pavements.
Traffic is slow but moving, mostly because cars are slowing down to look at the activity.
A group of friends from Setiawan don hard hats to celebrate Labour Day and protest. They are cheerful.
“We hate GST. If you owe money, pay your own debts – why burden the rakyat?” one of the Perakians ask the government.
12.37pm: Dataran Merdeka – Two Chinese tourist when met say they are not worried at the sight of over one hundred police personnel surrounding Dataran Merdeka.
The first time visitors remain relaxed, and one who wants to remain anonymous tells Malayhsiakini the rally shows the government is willing to listen to the people.
“We are not really shocked or worried, the atmosphere is somehow very relaxed.
“This is a very rare sight in China,” she says.
Although the iconic square is sealed off, police still allow the tourists to pass through the blockade and they proceed to take photos at the tourist spot.
12pm: Dataran Maybank – Over 200 gather here, some with banners ‘GST burdens the rakyat’, ‘How are the rakyat expected to live?’ and ‘Suffer Suffer Suffer’.
About 50 PAS’ Unit Amal are here but not political leaders are seen yet. About 20 police personnel are present.

11.15am: Twelve police buses and trucks have arrived at Dataran Merdeka. At Sogo, a crowd is building up. There are peddlers as well, selling anti-GST t-shirts and bandanas. A police patrol car spotted a few minutes later, and five policemen are on standby.

Crowd starts to gather for anti-GST rally

More than 10,000 are expected to gather for the first major protest of 2014 as a coalition of 89 NGOs organise the May Day rally to campaign against the Goods and Services Tax (GST).

11.19am: Dataran Merdeka – Although the organisers had reached a consensus after several rounds of meetings with the police for permission to gather at Jalan Raja, the authorities have nevertheless sealed the particular road.

Vehicles are not allowed to pass through the road, which is between Dataran Merdeka field and Sultan Abdul Samad building.
However, civilians are still allowed to pass through the blockade where more than one hundred people are present, resting at several spots while waiting for the actual event to begin.
Heavy police presence is spotted at the road but there is no sign of the FRU.
11am: The entrance to Masjid Negara has been closed to traffic. There are three traffic policemen at the entrance. Rally participants are beginning to gather outside the mosque.

10:40am: Since 9am, participants, clad in red, have been gathering at the Sogo shopping complex. There are four Kuala Lumpur City Hall (DBKL) enforcement officers in the vicinity whereas Sogo has stationed six security personnel at the main entrance of the mall.

10.20am: There is a festive air near Masjid Negara as scores of rally participants gather. Participants have been arriving since 5am and there are also shops selling anti-GST merchandise, including red t-shirts.

Police aiming for smooth anti-GST rally tomorrow

The police will ensure cooperation on their part for a smooth anti-GST rally tomorrow in Kuala Lumpur, Kuala Lumpur chief police officer Mohmad Salleh said today.
“Personally, I feel this rally will start and end well,” Mohmad said, after four engagement sessions with the rally organisers over the past couple of weeks.
“We have told them that Dataran Merdeka is out of bounds because it is under renovation,” he added.
He said that while people are allowed to walk in huge groups from the four gathering points for the rally, they are not allowed to use loudspeakers or chant while proceeding to the rally point.
He estimated there will be 10,000 to 15,000 people participating in the rally tomorrow.

Police agree to allow May Day rally, with conditions
1. The organisers of the anti-goods and services tax (GST) rally scheduled for tomorrow claimed they have been given permission to gather at Jalan Raja, the main road facing Dataran Merdeka.
2. Organising committee member PAS deputy president Mohamad Sabu said the participants will don red colour, as a symbol of the struggles of the labour force, while the Jalan Raja road will be closed for the rally scheduled to start at 2pm.
3. However, Mat Sabu said, the police will not allow the participants to march. They must instead “walk” to Jalan Raja from the four determined gathering locations – Masjid Negara, Sogo departmental store, Dataran Maybank and KLCC.

‘Organisers of anti-GST rally can’t be charged’

The authorities must refrain from arresting and charging organisers of the May 1 anti-Goods and Services tax rally, in light of the landmark Court of Appeal decision on Friday that declared the punishment under Section 9 (5), is unconstitutional.
Bar Council president Christopher Leong said the attorney general should not proffer any charges on the organisers due to the appellate court’s decision, or keep the charge in abeyance.
He said this is because the Court of Appeal’s decision is now considered the law.
“The AG Chambers would have to appeal the Court of Appeal’s decision and wait for the outcome before charging anyone,” he emphasised, when asked on the position of the law in light of Friday’s appellate court decision and tomorrow’s expected rally against the implementation of the GST.

Don’t fear cops, rally goers told
The police will be the ones breaking the law if they take action, says Lawyers for Liberty.
PETALING JAYA: Lawyers for Liberty (LFL) today assured organisers of the May 1 rally and intending participants that they need not fear police action.
Citing a recent Court of Appeal decision, LFL founder N Surendran said the public demonstration against the introduction of the Goods and Services Tax (GST) would be legal even without a police permit.
“If the police take action, they are going against the Court of Appeal’s judgment, and they will be the ones breaking the law,” he told FMT.
“I encourage Malaysians to exercise their right to freedom of assembly. Ignore the illegal warnings and assemble peacefully.”
He urged the police not to “behave like gangsters”.
The rally, organised by 95 civic groups, will be held in the vicinity of Dataran Merdeka.

Three students nabbed over anti-GST protest

Three activists were reportedly detained this morning during an anti-GST flashmob in Sabah, allegedly under a law that court has ruled unconstitutional.
Human rights group Suaram told Malaysiakini the police cited Section 9(5) of the Peaceful Assembly Act 2012 (PAA), which was on Friday already declared unconstitutional by the Court of Appeal.
The three are Gabungan Mahasiswa Islam Se-Malaysia (Sabah) chairperson Mohf Fathihie Daiman, Gabungan Anak Muda Menuntut Hak Rakyat Sabah (Gegar) spokesperson Khairuddin Daud and Gegar activist Firman Firdaus.
The trio were among some 30 people who conducted a flashmob protesting the impending Goods and Services Tax at Gaya Street, Kota Kinabalu.

Cops: Don’t attend May 1 rally

The Kuala Lumpur police contingent has warned against participating in a rally organised by several NGOs on May 1 due to issues with the proposed venue.
In a press release today, the police said Dataran Merdeka, which the organisers of the rally intends to use, is off limits due to ongoing construction works and organisers have not specified an alternative venue.

Bersih: Cops can’t use PAA to stop May 1 rally

The police cannot use the Peaceful Assembly Act to act against the May 1 anti-GST rally in Kuala Lumpur because it is Labour Day, which is celebrated all over the world, electoral watchdog Bersih says.
The police must give the rally the same commitment for a smooth passage, as they are doing for US President Barack Obama’s two-day vist to Malaysia this weekend, the Bersih 2.0 steering committee said in a statement released yesterday.
“The police cannot use the Peaceful Assembly Act 2012 to stop the rally. Workers’ Day all over the world is traditionally celebrated,” Bersih said, referring to the statement by Dang Wangi district police chief ACP Zainuddin Ahmad (left) that the rally, organised by NGOs and Pakatan Rakyat parties, is illegal.

Anti-GST rally permit for Dataran shot down
The police have rejected the application to hold the May 1 anti-Goods and Services tax rally at Dataran Merdeka.
This follows the organisers’ failure to give notice and gain approval from the location owners, Berita Harian reported.
The report quoted Dang Wangi police chief Zainuddin Ahmad as saying that although the police received an application, it had to be rejected as it failed to meet conditions under Section 9(1) of the Peaceful Assembly Act.
“The organisers failed to fulfill the conditions of the section to give notice and gain approval from the location’s owner to march and gather at Dataran Merdeka.
“The organisers only gave a notice to inform police but no approval was gained from the owners, resulting in their application being rejected,” he was quoted by the daily.

Another tug-of-war over Dataran as rally venue
Organisers of the anti-GST demonstration scheduled for May 1 are adamant on using Dataran Merdeka as the final rally point, while the police are firmly against it.
The rally is supposed to begin at KLCC, followed by a procession to Dataran Merdeka.
However, inspector-general of police Khalid Abu Bakar said organisers have been told that Dataran Merdeka is currently under repairs and can’t be used.
He said that this has been conveyed to rally organisers during a discussion on April 16.
“The police are still waiting for their response. We hope for their cooperation,” he told a press conference in Putrajaya.
Khalid was referring to the meeting involving PSM secretary-general S Arutchelvan, along with other NGO leaders. The police were represented by KL public order and internal security chief SAC Wan Abdul Bari Wan Abdul Khalid and Dang Wangi district police chief Zainuddin Ahmad.
Among the NGO’s participating in the rally are Solidariti Anak Muda Malaysia (SAMM), Anti price-hike group (Turun), Jaringan Rakyat Jerit Tertindas (Jerit) and an organisation representing the Orang Asli.

No Dataran Merdeka, FT minister tells anti-GST brigade
KUALA LUMPUR, April 20 — City Hall will not allow organisers of a May Day rally to congregate at Dataran Merdeka, Datuk Seri Tengku Adnan Mansor said today.
The federal territories minister warned protestors to steer clear of the historic city square.
He added that the Kuala Lumpur City Hall (DBKL) had not received any notice for a gathering there to oppose Putrajaya’s roll-out of the Goods and Services Tax (GST) next year.
“But even if they asked we will not allow it, that’s for sure,” he told reporters here.

Tian Chua: May 1 anti-GST rally not organised by us
PKR vice president Tian Chua says that it is not necessary for him to give a statement to the police as he is not the organiser for the May 1 rally.
PETALING JAYA: It is not necessary for me to give statement to the police on the May 1 rally, said PKR vice president Tian Chua today.
“We are not the organiser of the May 1 rally. PKR’s participation in the upcoming gathering is just to object the implementation of the Goods and Services Tax (GST) and support workers’ demand,” he said.
Yesterday, the Dang Wangi police had summoned Tian Chua to give statement today on his participation on the upcoming May 1 rally, organised by Solidariti Anak Muda Malaysia (SAMM).
The rally, according to SAMM coordinator Badrul Hisham Shaharin, is to oppose the government’s move to introduce GST, come April 2015.
Tian Chua, who is also Batu MP, said that he would not be able to help the police if they question him on the details of the rally.
“So it is best if they talk to the NGO (SAMM),” he said.

Massive anti-GST rally planned for May 1

A coalition of 89 NGOs and Pakatan Rakyat are planning a mass street rally on International Labour Day as a referendum against the Goods and Services Tax (GST).
The May 1 Rally Committee said the protest at Dataran Merdeka is aimed at sending the government a “real message” that the people will not be fooled by its million ringgit “cartoon” GST campaign.
“(If) we don’t protest this year, next year we will be April Fools,” Parti Sosialis Malaysia secretary-general S Arutchelvan told a press conference in Kuala Lumpur today.
“The government has to come up with caricatures and cartoons to campaign for the new tax because no real people will say they like this GST.”
The rally – themed ‘GST – Protest till it is dropped’ – aims to draw the participation of students, who will be among the hardest hit by the tax due to be imposed from April next year.
