Check law first, Karpal asks Penang government over decree banning ‘Islamic words’

The DAP has asked the Penang government to seek legal advice on the ruling that non-Muslims in the state cannot use 40 “Islamic words”, including Allah.
Party chairman Karpal Singh (pic) said this follows an announcement by the Penang Mufti’s office that non-Muslims could be charged if they violated a decree.
“It will certainly be in order for the Penang state government to seek legal advice on the prohibition announced by the Penang Mufti before any non-Muslim is charged for an offence for use of the words,” Karpal said in a statement today.
The ban on the words are provided under sub section 48 (3) and (4) of the Penang Islamic Religious Administration Enactment 2004 as exclusive to Muslims.
The decree was enforced on April 29, 2004, when Penang was under Barisan Nasional rule.
The Yang diPertuan Agong is the head of the Islamic religion in Penang.
Those found flouting the decree could be charged under section 3 of the Syariah Criminal Offences Enactment (Penang) 1996.

ANALYSIS Although the 10-point solution allows Christians to use, import and print the Bahasa Malaysia Bible in Peninsular Malaysia, it is trumped by enactments in 10 states which prohibit the use of 34 words and phrases by non-Muslims.
These words, including ‘Allah’, appear in the Bahasa Malaysia and Iban language Bible, rendering the printer and distributor of these copies liable to criminal action.
Likewise, churches that hold services in Bahasa Malaysia and other indigenous languages, in which the word ‘Allah’ is used, also run the risk of having religious authorities banging on their doors.
As the ban is on publication, printing and uttering these words in a public speech, it is not a stretch of imagination that members of the congregation could run afoul of the law, too, and face a fine of up to RM1,000 if found guilty.
The National Evangelical Christian Fellowship (NECF), which has a Bahasa Malaysia commission, has declined to provide figures for just how many Christians in the peninsula worship in Bahasa and indigenous languages for fear of backlash.

Migration from East to West
Those familiar with the situation say that the growth of number worshipers seeking Bahasa services has nothing to do with propagation, but is due to greater migration from East to West Malaysia.

There are about 40,000 Sarawakians in Johor, mostly Iban, while there is no estimate for the Sabahan population in Johor.
Church leaders who spoke to Malaysiakini under condition of anonymity, said there are also Indians, Chinese and Orang Asli in the peninsula who opt to worship in Bahasa as they cannot read in other languages and are less confident in English.
“The Indians and Chinese, especially, are those who went to government schools and cannot read and write Tamil or Chinese. They prefer Bahasa and there are now two generations like this.
“To cater to them, churches in the peninsula have been providing Bahasa services since the 1970s, some as early as 1960s,” one source said.

Cops grill Catholic priest under sedition law over ‘Allah’
SHAH ALAM, Jan 7 — The Selangor police are investigating Catholic priest Father Lawrence Andrew under the Sedition Act 1948 for his statements in a news report over the “Allah” issue, his lawyer said today.
Francis Pereira said Selangor police had questioned Andrew under Section 4 of the controversial law, but confirmed that no charges have been brought against the priest.
“They have classified it under Section 4 of the Sedition Act so the questioning was in respect of that offence,” the lawyer told reporters at the Selangor police headquarters here.

Perkasa full of rubbish, says Marina Mahathir on group’s criticism of her
Datin Paduka Marina Mahathir will not be dragged into a fight with Malay rights group Perkasa, who had accused her of seeking cheap publicity by supporting the Christians in the Allah controversy.
Marina, who is the daughter of Perkasa patron Tun Dr Mahathir Mohamad, had refused to comment when she was asked about Perkasa’s criticisms against her.

As 50 Muslims protest, 900 Catholics pray for priest
KLANG, Jan 5 — Threatened with police action, a Muslim group shifted its protest against Rev Father Lawrence Andrew today to the carpark of the nearby Stadium Sultan Sulaiman here to rail against the Catholic priest they branded “seditious” for insisting Christians can call their God “Allah”.
The rally organised by the Klang Muslim Solidarity Secretariat, a group affiliated with Selangor Umno, however, was planned to be staged outside the Church of Our Lady of Lourdes.
At the rally, which drew just 50 people, Mohd Khairi Hussin, who is the president of the sectretariat, read aloud from a memorandum he had initially intended to hand over to the Catholic priest after the protest.

Outside the Church of Our Lady of Lourdes, some 20 Muslims and non-Christians chose to stand in solidarity with the minority religious community while the 900-strong Catholic congregation celebrated Mass.
They came as early as 8am, bearing flowers.
Social activist Datin Paduka Marina Mahathir was also present and told reporters that the Arabic word for God belonged to everyone.
The 86-year-old church was packed, resulting in the congregation spilling onto makeshift pews outdoors.

Marina slams leaders for silence as Christians threatened

Social activist Marina Mahathir slammed government leaders for failing to speak up when conservative groups threatened to demonstrate in front of churches over the past week.
Muslim pressure group Solidariti Ummah Klang is demanding that Christians conform to a government ban that prevents them from using the word ‘Allah’, which they say is exclusive for Muslims.
Marina this morning turned up in front of the Lady of Lourdes Church in Klang with some 40 people, mostly Muslims, in solidarity with Christians as the Muslim group protested at a nearby field.
She hit out at the government for refusing to rein in such conservative groups that have taken a confrontational stance.
“Our leaders should not be silent. Everyone is complaining that the silence is deafening and far from elegant. It is certainly incriminating.

Nearly 1,000 Catholics turned up for Sunday mass at the Our Lady of Lourdes Church in Klang, Selangor, this morning expecting an angry mob of Muslims protesting the possible use of the word Allah in prayers but instead, met a group bearing flowers.
Among the few Muslims who turned up was social activist Datin Paduka Marina Mahathir, who brought a bouquet of flowers, and was part of a group expressing solidarity with the Christians.
The daughter of former prime minister Tun Dr Mahathir Mohamad lambasted Putrajaya over its inaction and told it to forget about the ambitious Visit Malaysia Year launched with much fanfare last night.

Mixed-faith ‘solidarity gathering’ to protect Klang church from Muslim protesters
KUALA LUMPUR, Jan 5 — Ahead of a planned protest by Muslim groups outside a Klang church this morning, a group of Malaysians of different religions have decided to band together to protect and support the Christians there.
Azrul Mohd Khalib, one of the co-ordinators of this “solidarity gathering” at the Church of Our Lady of Lourdes in Klang, said it was born out of concern over the state of religious freedom in Malaysia.

“Basically this proposed gathering outside the church tomorrow is where a lot of people have decided that enough is enough and we need to be able to protect our brothers and sisters.
“Malaysians have every right to practise their religion the way they see fit. We should not be in any way restricting or preventing or involving ourselves in any way which prevents them from doing so,” the human rights activist told The Malay Mail Online when contacted yesterday afternoon.
Azrul explained that the “solidarity gathering” was “inspired” by the events in Egypt during the toppling of the government there, where “Muslims held hands to form a band around churches that were threatened by the violence that was going on.”
A Facebook event page for the gathering titled “IN THE NAME OF ALLAH” was only started yesterday morning, but over 200 Malaysians including social activist Datin Paduka Marina Mahathir had confirmed their attendance, Azrul said.

Selangor Umno has dropped a planned protest outside a church in Klang tomorrow, but not without a warning to Father Lawrence Andrew, the editor of Catholic weekly Herald.
“Father Lawrence, don’t be rude (biadap)… if you want to show ‘besar kepala’ (big-headed), don’t be shocked if the Malay non-governmental organisations carry out a mega demonstration,” said Selangor Umno liaison chief Datuk Seri Noh Omar.
“He was the one who started it…the culprit here is Father Lawrence… not the Christians in general,” he added.
Noh said the protest tomorrow was shelved to avoid a “religious war”.
“We do not want this to spiral into a heated religious war and create unwanted tension.
“Why must we disturb other Christians and priest because of one man who does not understand the law?” he asked.

We won’t retreat into a state of fear, says parish priest of church targeted by protesters
KUALA LUMPUR, Jan 3 — The Church of Our Lady of Lourdes in Klang has announced that it will continue its services on Sunday, despite a planned protest on Sunday morning by a Malay coalition over the word ‘Allah’.
In a post on its Facebook page here, the church’s priest Father Michael Chua also asked parishioners to remain calm and avoid any confrontation with the protesters.
“All activities of the parish including masses and the opening of Sunday School will continue as scheduled. We should not allow this issue to compel us to retreat into a state of fear,” Chua wrote here.
“But above all, I urge all of you to keep this matter in prayer. Let us pray to Almighty God that good sense and wisdom will prevail.”
Chua added that the church has spoken with its Catholic lawyers and will hold a discussion with the district police to ensure the safety of its parishioners and the sanctity of the church.
The South Klang police has since assured the public that it will be providing protection towards the church and patrol the area surrounding it on Sunday.
In addition, the church’s Ministers of Hospitality will also work together with volunteer corps RELA to assist churchgoers and facilitate traffic control.
“A response team of parish representatives will be on duty to receive any memorandum. I appeal to all parishioners to remain calm and to avoid any confrontation with the protestors, if any,” Chua added.

Christians seek police protection
The Christian Federation of Malaysia (CFM) is seeking police protection ahead of a protest march planned by Muslim groups against the use of the word ‘Allah’ by Christians in Klang, Selangor this Sunday.
Welcoming police warnings against the march, CFM hopes police will be present at the Our Lady of Lourdes Church to ensure safety of the worshippers and church.
“We call upon the police and the relevant authorities to do their sworn duty to protect and defend the rights of the Christian minority in Malaysia and to ensure that the sanctity of our places of worship and the safety of our members are not in any way violated.
“It is incumbent on the police and the relevant authorities to ensure that our places of worship are not desecrated or defiled and our worship services not disturbed by these protesters and their threatened actions,” CFM chairperson Eu Hong Seng said in a statement.

As a planned Umno protest looms on Sunday, police assured a senior Catholic priest at the centre of the Allah storm by providing protection and assistance to churches in the Klang area today.
Catholic weekly Herald editor Rev Father Lawrence Andrew said he met with police at the South Klang police station today at noon after it had called him for a chat at the South Klang police station. The police said they will patrol the area where the churches are.
“Three officers were there. We chatted for about 30 minutes and they gave me an assurance to the church that patrol cars will be deployed on that day to ensure the safety of the church,” he told The Malaysian Insider

“We will take stern action,” state police chief Datuk Mohd Shukri Dahlan said in a text message to theSun today.

The coalition calling themselves the Klang Muslims Solidarity Secretariat blamed church leaders for sparking the current row over the Arabic word and threatened an “uprising” if their demand to stop non-Muslims from using it is ignored.
“We will not conspire and give permission to any churches to use the word ‘Allah’, and this includes other non-Muslims as well,” the secretariat’s president, Mohd Khairi Hussin told reporters here.
The rally is expected to draw Muslims from around the Klang area, and participants will gather at 9am before marching towards the 85-year-old Catholic church to deliver a memorandum expressing their dissatisfaction.

The secretariat confirmed today that another protest will happen simultaneously at the Metro Tabernacle Church in Taman Samudera, Gombak on Sunday, followed by similar protests around Selangor in the days after.
