Court of Appeal upholds RM318,000 award over wrongful police shooting

KUALA LUMPUR, April 15 — The Court of Appeal upheld today a lower court verdict that awarded about RM318,000 to a woman who had sued the police for shooting her.

According to a Malaysiakini report, Justice Datuk Abang Iskandar Abang Hashim dismissed the police’s and government’s appeal and ruled that the appellate court should not interfere with the Kuala Lumpur High Court’s decision in Norizan Salleh’s case.

“The High Court judge has not erred in law and in the findings of fact,” Abang Iskandar was quoted saying.

The Court of Appeal panel also reportedly ordered the police and government to pay RM10, 000 in costs to Norizan.

Court awards RM300,000 to housewife shot by police

KUALA LUMPUR: A housewife who survived being shot in the lung by police in 2009, has been awarded more than RM300,000 in damages by a High Court here.

Norizan Salleh had filed the suit against the police and the Government for assault and battery.

High Court judge Justice Hue Siew Kheng awarded Norizan RM50,000 in General Damages for the pain and suffering; assault and battery for RM50,000; RM200,000 in exemplary damages to ensure public bodies did not act unlawfully and RM18,326 for the medical bills.

Justice Hue also instructed the defendants to pay RM30,000 cost to Norizan.

Senior Federal Counsel Wan Suhaila Mohd acted for the defendants and counsels N. Surendran and Latheefa Koya acted for Norizan.

Homemaker, who was shot in the lung, to know suit verdict on Sept 4

KUALA LUMPUR: A homemaker, who survived being shot in the lung by police in 2009, will know the outcome of her suit against the police and the Government on Sept 4.

Senior Federal Counsel Wan Suhaila Mohd, who acted for the defendants, and the housewife’s lead counsel N. Surendran, said High Court judge Justice Hue Siew Kheng wanted both parties to make further submissions with regard to the case.

A medical report by HKL dated May 12, 2010, noted that Norizan had puncture wounds on her wrist, forearm, right arm and chest, adding that a bullet was lodged in her lung.

KUALA LUMPUR (Sept 27): Police officer Mohd Firdaus Rosli who allegedly accidently shot Norizan Salleh on Oct 30, 2009, does not believe that multiple firearms discharging at a single moving vehicle on the Middle Ring Road 2 (MRR2) will endanger the lives of the public.

At the Kuala Lumpur High Court today, Mohd Firdaus disagreed with Norizan’s lead counsel N Surendran when the latter asked if his and his fellow officers’ action of firing continuously at the car was more dangerous than letting the car (with Norizan) escape.

However, he was unsure that 15 firearms were fired at the car on the night of the incident.

Police fired shots without warning, woman testifies in civil suit

An unemployed woman told the High Court today that police had intentionally shot her during a car chase four years ago.

Norizan Salleh, 33, who is pregnant and due next month, also said she overheard a policeman saying that she and her three friends in the car would have been dead if the incident did not take place in a busy area.

“I was already shot but still conscious although I was having breathing difficulties,” Norizan told the court.

In her statement of claim, she said at 4.30am on October 30, 2009, a police patrol unit approached the car in which she was a passenger when policeman Mohd Firdaus suddenly opened fire.

Norizan tried to get out but was kicked and stepped on by Mohd Firdaus. She claimed that by then about 14 to 20 police officers had arrived at the scene.

She was taken to Hospital Kuala Lumpur where she underwent surgery. Norizan said she also had surgery at the National Heart Institute to remove a bullet which was lodged in her lung.

In her testimony today, Norizan said she was in a car with her friends, Khairul Aizat Razali, A. Muiz, who was driving, and Muiz’s girlfriend, Mumtaz.

“We were on the way to my house in Segambut Permai when suddenly a police patrol car approached us on the right. We were shocked when a man pointed a gun at us.

“They did not even give us any indication to stop our car. There was no siren or flashing lights,” she said, adding she was seated at the back with Khairul. – September 20, 2013.

Woman wants cops to admit they shot her wrongfully

KUALA LUMPUR: A Judge has asked the parties involved in the civil dispute filed by a woman who survived after being shot in the lung by the police to settle the matter.

Norizan Salleh, 33, who is now pregnant, has claimed that she did not commit any crime, which would have justified the police firing at her while she was travelling in her friend’s car.

Her lead counsel N.Surendran told the media Thursday that the housewife would agree to settle the claim if there was an admission on liability.

“It is not about money. She wants them (police) to admit that the shooting was wrongful,” he said.

He said if no agreement could be reached by the parties, Norizan would testify in court on Friday at 10.30am before High Court judge Justice Hue Siew Kheng.

Norizan Salleh’s lawyer says it is a miracle that his client is still alive.

KUALA LUMPUR: A 32-year-old single mother, who cheated death in a police shooting incident in 2009, has filed a civil suit at the High Court here today.

Norizan Salleh, who is unemployed, named the government, inspector-general of police, Sentul district police chief and police personnel Mohd Firdaus as defendants.

In her statement of claim, Norizan, who sustained five shots, alleged that the police violated its standard operating procedure to open fire at a moving car in which she was seated at the back on Oct 30, 2009.

The Proton Perdana, driven by her friend Khairul Aizat, was on the MRR2 highway when a police patrol car suddenly appeared from the right at about 4am.

Norizan claimed that Mohd Firdaus, who was one of two police personnel in the car, took out a firearm and pointed at the car.
