Sex bloggers freed over ‘insulting Muslims’ charge

Sex bloggers Alvin Tan and his former partner Vivian Lee have been freed over the charge of insulting Muslims with a Facebook posting showing the pair eating pork soup (bah kut teh) with the words “Selamat Berbuka Puasa” during the fasting month.

The Federal Court unanimously dismissed the prosecution’s appeal over the Court of Appeal’s decision in freeing the two of the charge under Section 298 A of the Penal Code.

“This follows the apex court allowing our preliminary objection that the Federal Court does not have the jurisdiction to hear the prosecution’s appeal.

“This is because the case originated at the Kuala Lumpur Sessions Court and hence, whatever decision and appeal should end at the Court of Appeal,” their lawyer Chong Joo Tian told Malaysiakini.

MALAYSIA HAS ASKED INTERPOL TO LOOK FOR ALVIN TAN!

Interpol is looking for controversial sex blogger Alvin Tan Jye Yee to face trial in Malaysia following his failure to return and surrender his passport to the court, his lawyer said.

Chong Joo Tian said Tan and his partner Vivian Lee May Ling went to Singapore to shoot a documentary last May but the lawyer was unsure if Tan was still in the island republic.

“The assistance of Interpol has been enlisted to locate and bring Tan back to face charges with Lee,” he told The Malaysian Insider. The Sessions Court had issued an arrest warrant for Tan.

Chong said it was up to the prosecution to decide whether to try only Lee in the absence of Tan.

Sex blogger’s mum: I don’t know where my son is

KUALA LUMPUR: The mother of sex blogger Alvin Tan Jye Yee told the Sessions Court here that she had no idea of his whereabouts after he failed to return his passport for the third time.

“I miss him,” said All Kim Lian, 57, adding that although she had tried to contact her son and even left messages for him, there was no reply.

“I waited for him to return but I can’t find him. I am old and I do not know much.

“I hope that the court will not take away my money (the RM20,000 bail),” she said before Sessions judge Abdul Rashid Daud here yesterday.

Another bailor, Loo Ching Ching, 44, said her efforts to contact Tan via telephone and text messages had also been futile.

Yong then submitted that both bailors were close to Tan, adding that it was not possible for All not to know her son’s whereabouts.

KUALA LUMPUR: The Sessions Court forfeited the RM20,000 bail imposed on controversial sex blogger Alvin Tan after he failed to return his passport for a second time.

“Both bailors failed to show sufficient cause under Section 404 of the Criminal Procedure Code.

KUALA LUMPUR: A warrant of arrest has been issued for sex blogger Alvin Tan Jye Yee by the Sessions Court here for failing to return his passport, after leaving for Singapore on May 18.

Sessions Court judge ‎Abdul Rashid Daud made the order after allowing an application by deputy public prosecutor Haffiza Jemeli on Friday.

The court later fixed July 18 to determined if Tan should to be allowed bail or not.

On May 12, Abdul Rashid had granted an application by Tan and Vivian Lee May Ling to have their passports released.

Abdul Rashid Daud had made the order after Tan and Lee’s counsel Chong Joo Tian told the court that his clients would be in Singapore to shoot a documentary film on their lives there.

The couple were allowed to retain their passports between May 18 and June 3 to enable them to travel to the island republic.

Sex blogger duo Alvin Tan (left) and Vivian Lee with their lawyer J. T Chong speaking to reporters after having one of their three charges against them struck out by the Court of Appeal.

PUTRAJAYA: The Court of Appeal here struck out one of the charges against sex bloggers Alvivi over their Ramadan Facebook posting, ruling that it does not apply to non-Muslims.

Justice Mohtarudin Baki allowed the duo’s application Monday, declaring that Section 298A(1) of the Penal Code was non-applicable and non-enforceable against them.

Alvin Tan Jye Yee, 26, and Vivian Lee May Ling, 25, had appealed to have the charge under Section 298 – for stirring hostility between religions – struck out on the grounds the law was meant to ensure smoothness of the practice of Islam among its followers, not those of other religions.

The unanimous decision by the panel – which included Justices Rohana Yusof and Tengku Maimun Tuan Mat – means the duo need only face two charges in their trial at the Session Court in Kuala Lumpur.

The charges that still stand are for allegedly publishing a photograph with the comment “Selamat Berbuka Puasa (dengan bak kut teh…wangi, enak, menyelerakan)” which contained a halal logo and possibly seditious statements, and for displaying pornographic images on their blog.

Criminal lawyers question why sex bloggers not given bail

by V. Anbalagan
July 19, 2013

What if the sex bloggers are found not guilty?

The time spent in jail as remand prisoners cannot be reversed and this would amount to a travesty of justice for sex bloggers Alvin Tan and Vivien Lee.

In pointing this out, criminal lawyers are aghast the infamous couple were not granted bail when they were charged yesterday with three charges related to their Ramadan bak kut teh greeting on their Facebook page and pornographic pictures in their blogs.

“They are innocent until proven guilty,” said Rajpal Singh.

Rajpal said under normal circumstances bail would have been offered to those who were charged with similar offences faced by the two.

“I feel bail should have been offered to the two because they did not plead guilty to the charges,” he said.

He said Sessions court judge Murtazadi Amran did not use his discretion to offer bail judiciously.

Criminal law lecturer Datuk Baljit Singh Sidhu said Section 389 of the Criminal Procedure Code clearly states that bail is offered to secure the presence of the accused in court.

He said case laws over the years had also emphasised that the court could offer bail to accused persons provided there was no attempt to interfere with witnesses.

Other reasons could be that the accused did not abscond or tamper with evidence, he said.

He pointed out that in non-bailable offences like murder, they were instances when the court had offered bail.

Lawyer Paul Krishnaraja said having read the court proceeding yesterday he too was stunned that the judge had applied the wrong principle in rejecting bail.

OVERKILL: Alvin, Vivian may get up to 15 YEARS JAIL as Muslim hardliners gain upperhand

Written by Maria Begum, Malaysia Chronicle

KUALA LUMPUR – Sex bloggers Alvin Tan and Vivian Lee were not only unable to escape being charged under the dreaded Sedition Act but it looks like Prime Minister Najib’s government was “so confused” they decided to charge the duo under 3 separate laws.

The overkill may however be counter-productive as suspicion is already running high that the duo – while in the wrong – were being exploited and victims of a high-stakes power-play at Umno, Najib’s political party.

An MP from the Islamist PAS had a day ago warned against hypocrisy.

“Yes, Muslims get very upset and angry when the non-Muslims insult Islam. But strangely, when Muslims insult other religions, everybody is quiet and no one speaks up,” Dr Siti Mariah Mahmud, the MP for Kota Raja, had told a press conference at the Parliament lobby a day ago.

Overkill: Pawns in Umno’s high-stakes power-play?

Alvin and Vivian had been expected to be charged under the Communications & Multimedia Act at the Kuala Lumpur Sessions Court at Jalan Duta on Thursday afternoon, sources close to the duo had told Malaysia Chronicle.

“I know the minister has said there are 3 laws under which they can be charged but there is also the burden of proof. That’s not so easy because these two have insulted and offended a lot of people but that may not be criminal. Basically there are only two laws to use – the Communications and Multimedia Act or the Sedition Act,” said one of the sources.

However, it appears there has been some late-minute change in plans.

The duo were denied bail and remanded to prison after they were charged under three laws for their controversial Ramadan greeting posted on Facebook and for uploading sex video clips on the web last year. They were charged under the Sedition Act, the Film Censorship Act and the Penal Code at the Kuala Lumpur Sessions Court.

They face a maximum jail sentence of 15 years each, with fines, if convicted of the three charges.

Alvivi charged over sex and religion, denied bail

Controversial couple Alvin Tan and Vivian Lee today pleaded not guilty at the Kuala Lumpur Sessions Court to three charges related to their action in posting their Ramadan bak kut teh greeting on their Facebook page and pornographic pictures in their blogs.

The charges against Alvin Tan or his full name, Tan Jye Yee, 25, and Vivian Lee or Lee May Ling, 24, were read before judge Murtazadi Amran.

The couple were also denied bail. Tan will be held at the Sungai Buloh prison while Lee is to be housed at the Kajang Prison pending trial. The case will be up for mention on Aug 23.

Judge Murtazadi denied bail for both accused after taking public interest into account.

He said the court was not affected by external elements in deciding on the bail.

Earlier, deputy public prosecutor Noorin Badaruddin asked the court not to grant bail to the accused as the charges under Section 298A (1) (a) of the Penal Code and the Film Censorship Act were non-bailable offences.

“Of course, we accept the court discretion to allow bail on the two charges, but the prosecution objected to any bail granted until the trial is over,” he said.

Noorin said secondly, both accused had a tendency to upload pictures that could arouse public outrage.

Alvin, Vivian likely to escape Sedition Act, all eyes on IGP to explain “linked” remarks

Written by Maria Begum, Malaysia Chronicle

KUALA LUMPUR – Sex bloggers Alvin Tan and Vivian Lee are expected to be charged under the Communications & Multimedia Act at the Kuala Lumpur Sessions Court at Jalan Duta on Thursday afternoon, sources close to the duo told Malaysia Chronicle.

Someone exploiting the issue?

However, some critics have accused extreme groups such as Perkasa and Jati as well as hardline members of Prime Minister Najib Razak’s Umno party of exploiting the issue and fanning the flames.

Ill-judged and insensitive their greeting is, the couple’s action also comes smack in the middle of a heated political debate on Najib’s government should retain the Sedition Act and introduce replacement laws for the repealed the Emergency Ordinance and Internal Security Act.

Comments from the Inspector-General of Police Khalid Bakar that a case involving a 21-year-old Chinese man who was abducted while having drinks with his girlfriend also raised eyebrows, casting doubt once again on Khalid’s neutrality and professionalism as a police officer.

Khalid had linked the abduction to the Alvin and Vivian incident.

Abducted for money by glue-sniffing group

But the victim, Ng Mun Tatt, has since made public his account of the story.

He was abducted and beaten for ransom, and the abductors called his brother-in-law to demand RM5,000 in ransom. The amount was eventually reduced to RM3,000 and banked into Ng’s account.

Calls to Khalid to clarify his remarks

Khalid, known for his political inclinations and accused of subservience to top Umno leaders, has yet to explain his remarks.

Based on Ng’s account, Khalid’s words would be untrue and unfair to Alvin and Vivian as they prepare to defend themselves in court.

Depending on the charges, the duo stand to face between 2 to 4 years in jail if found guilty.

Act fast against Muslim offenders too, says PAS

BY YISWAREE PALANSAMY
July 17, 2013

PAS wants the authorities to be consistent and take action against Muslims who offend the racial and religious sentiments of non-Muslims.

Its vice-president Datuk Mahfuz Omar and Kota Raja MP Dr Siti Mariah Mahmud said today in Parliament the authorities were quick to act on complaints made by Muslims but were indifferent when it came to non-Muslims’ complaints.

Dr Siti Mariah cited the case of sex bloggers Alvin Tan and Vivian Lee and their controversial Ramadhan photograph where action had been swift. It was no so when non-Muslim sentiment was involved, she said.

“Why the double standard against those who called for bibles to be burnt? Those who had hurt the religious sentiments of Hindus? It is also very wrong under the Islamic laws,” Dr Siti Mariah said, citing Perkasa chief Datuk Ibrahim Ali and its former vice-president Datuk Zulkifli Nordin who have a reputation for making controversial statements against non-Muslims.

Mahfuz said, “We need to look at ourselves as well before crying foul about others. Islam is fair and there should not be selected prosecution of anyone.”

Retribution is quick if you’re sex bloggers

COMMENT In a flash, the authorities cracked their whips when a non-Muslim couple, infamous for their exhibitionist sexual trysts, posted a photograph of themselves dining on pork (bak kut teh) soup.

The indignation is understandable. The posting was downright ridiculous and offensive. There is no excuse to belittle a faith and the couple should have been aware of the repercussions when trampling on what is sacrosanct to others.

NONEHowever, there appears to be two diametrically opposed approaches to such matters in Prime Minister Najib Abdul Razak’s 1Malaysia.

The same authorities, politicians and religious leaders did not even squeak when Perkasa vice-president Zulkifli Noordin (right) degraded the Hindu religion or when university lecturer Ridhuan Tee Abdullah derided the Thaipusam festival.

This begs the question whether Muslims have the right to be offended while others should just accept the blatant disparagement of their respective faiths as a fact of life in Malaysia.

Zulkifli, in a video recording of his sermon posted on YouTube, had ridiculed the Hindu belief that the Ganges River in India is sacred.

He also mocked Hindu deities for failing to prevent a flood from ravaging a shop that sold statues of these deities.

NONERidhuan (right), on the other hand, saw red over the attempts by certain organisations to lift the temporary ban imposed on a Tamil film, which critics claimed equated Islam with terrorism.

In his argument that appeared in a Malay-language daily, the associate professor, who ironically teaches ethnic relations, penned derogatory remarks about the Thaipusam festival in Batu Caves.

He also complained about the proliferation of Hindu temples and shrines since the 2008 general election.

In both cases, there were calls to take stern action against Zulkifli and Ridhuan, including charging them under the Sedition Act. However, these voices went unheeded.

For Hindus, an apology is sufficient?

And what about Perkasa president Ibrahim Ali’s incendiary remark to torch Malay bibles which contain the word ‘Allah’?

Mahathir, who is the patron of Perkasa, later defended Ibrahim, stating that it is common to burn banned publications.

And as if to rub salt into the wound, Najib, who fathered the 1Malaysia slogan, named Zulkfli as the BN candidate for the Shah Alam parliament seat in the last general election.

To make matters worse, Zulkifli is the vice-president of Perkasa, the right-wing movement with an unenviable track record of stoking racial and religious flames.

Defending his candidature, Deputy Prime Minister Muhyiddin Yassin had described Zulkifli as a man with calibre.

NONEMuhyiddin (left in photo) also reminded the people that Zulkifli had since admitted his mistake and apologised for insulting the Hindu faith.

So in the case of slighted Hindus, an apology is sufficient.

There is no justification for Alvin Tan and Vivian Lee’s action as freedom of expression cannot be used as a shield to rattle religious and racial ties.

But the same rule must also be extended to those Muslims who insult the faiths and beliefs of others. In short, 1Malaysia needs one approach on issues concerning religious rows. There should be no double standard.

Failing which, it would prove that 1Malaysia is the most hollow, superfluous, deceptive, insidious and deceitful slogan ever coined to hoodwink a nation.

Penang Chief Minister Lim Guan Eng is the latest to call for “full punishment” to be meted out to the young couple, who face serious charges and may end up in jail after sending ‘Sumptious Erotica’ and ‘pork-tainted’ Ramadan greetings to Muslims over Facebook.

“That is wrong. They deserve to be punished. There is no doubt about it. It is completely un-Malaysian. They are a complete disgrace,” Guan Eng, who is also the DAP secretary-general, told Malaysia Chronicle at the Parliament House on Monday.

Khairy: Sorry no cure, Alvivi should be punished

Sex bloggers Alvin Tan and Vivian Lee must face the full brunt of the law despite them apologising over their Facebook post which has incurred the wrath of Muslims, said BN Youth chief Khairy Jamaluddin.

Speaking to reporters after the BN Youth job fair soft launch, Khairy said that although they had apologised through Youtube, punishment must be meted to set an example.

Khairy said it would be unfair to the people if the case was closed and the offenders got off scot-free just because they had said sorry.

“Let this be a lesson to everyone (not to ridicule and mock other religions). This case is very serious – a stunt which, I believe, is sufficient to rouse the anger of many Muslims,” said Khairy, who is also the youth and sports ministry.

He said that the same approach should be applied not just for insults against Islam, but to all religions.

“We don’t want people to accuse us of selective prosecution when we mete out the punishment,” he said.

Action by Alvin and Vivian is extreme – Robert Phang

KUALA LUMPUR: Social Care Foundation chairman Tan Sri Robert Phang described as extreme the action by the couple, Tan Jye Yee (Alvin), 25, and Vivian Lee, 24, in uploading the photograph and caption that touched on the sensitivity of Muslims in the social website Face book yesterday.

Phang, who was approached by reporters at a media conference at the Jalan Tun Razak Police Station today, said the action had offended many Muslims who were now fasting in conjunction with Ramadan.

“It is not a healthy thing to do. We should stop such action and not allow it to happen,” he said.

Meanwhile, several Muslim non-governmental organisations (NGOs) in the country urged the government to review the MSC Malaysia Bill of Guarantees to check the abuse of the social media which was becoming more rampant.

Malaysian Muslim Consumers Association (PPIM) chief activist Datuk Nadzim Johan said the freedom of information enjoyed by Malaysians had clearly been abused and could become a ‘poison’ to national prosperity.

“There is a limitation to everything. Just like food, if it is consumed excessively, it will certainly cause illness and become toxic,” he said when contacted by Bernama here today.

Notorious ‘sex bloggers’ are back with Ramadhan insult: ‘BAK KUT TEH WANGI?’

Written by Bob Kee, Malaysia Chronicle

a

The infamous “sex bloggers”, Alvin Tan and Vivian Lee, are at it again. The main difference this time is that they are fully clothed.

The notorious duo caused a major scandal last October when their ‘sex-blog’ containing their naked photos and videos of their multiple romps, went viral in Singapore and Malaysia.

This time around, they seem intent on causing offence to the Muslim community while the community is observing one of the holiest periods of their calendar, the month of Ramadhan.

In a photo posted on their Facebook fanpage, the pair is seen enjoying a meal of ‘Bak Kut Teh’, a popular dish in which the main ingredient is pork – a meat that is expressly forbidden to Muslims. The common Ramadhan greeting of ‘Selamat Berbuka Puasa‘ (Happy Fast Breaking) appeared at the top with the Malaysian ‘Halal’ logo embellished on the photo.

The photo also carried the following caption:

Izinkan kami memperkenalkan cara kami memupuk semangat 1Malaysia dengan bertukar-tukar makanan antara kaum-kaum Malaysia pada musim perayaan yang mulia ini. Hak untuk menikmati juadah enak tempatan seharusnya merentasi batasan bangsa dan juga agama. Kepada saudara-saudari yang beragama Islam, selamat berbuka puasa dan Salam Aidilfitri! – Sahabatmu, Alvin dan Vivian.

(Allow us to introduce our way of inculcating the the spirit of 1Malaysia and that is by exchanging food between the races in Malaysia during this holy celebration. The right to enjoy local delicacies should cross the boundaries of race and also religion. To Muslims, happy breaking fast and Salam Aidilfitri – Your friends, Alvin and Vivian)

Reactions on Facebook

The photo caused an immediate backlash from both Muslims and non-Muslims who slammed the couple for their deliberate insult of Muslims and abuse of the ‘Halal’ logo.

Here are some of the more scathing comments that the photo elicited:

“I pity your lame effort of gaining cheap publicity by insulting others. Crass.”
– Elly Yusof

“Can we just ignore this shameless couple? They do not represent the Malaysian Chinese, they are the worst garbage… no respect for others and their own families.”
– Hazel Sia

“Ur trick wont make me sceptical to my chinese friend. This doesnt work. I think both of u have some sort of mental illness. Btw tanjung rambutan is ready for u.”
– Farzana Zamry

“Please respect my Muslim friends ! I am ashamed of you two! Put them into jail!”
– Choi Khiat Ong

Those two out for publicity. Why give it to them? How much did it cost parliament to debate that for 15 minutes? How much did it cost tax payers? Leave the unimportant to the state machinery, but debate about the large numbers who died in custody.
