Court to decide Lynas injunction application on July 26
THE High Court will decide on July 26 an injunction application by Lynas Corporation Limited and Lynas Malaysia Sdn Bhd to restrain ‘Save Malaysia, Stop Lynas’ (SMSL), an anti-Lynas group and five others from further publishing a defamatory article on Lynas.
Judge Datuk John Louis O’Hara fixed the date after hearing submissions from lawyer Rishwant Singh, representing Lynas, and Datuk Bastian Pius Vendargon who acted for SMLS and the other five defendants.
In the application, Lynas has sought for the defendants to remove the article from its blogsite until the disposal of the suit.
On April 19, Lynas Corporation of Sydney, Australia, and Lynas Malaysia filed the suit against SMSL Sdn Bhd and its two directors, Tan Bun Teet and Lim Sow Teow, and three volunteers Hang Chong Leung, Lee Chow Fong and Ismail Abu Bakar, over a defamatory article published on its blogsite, on March 22.

All across the country, projects like the Lynas Advanced Materials Plant, Petrochemical plant in Pengerang, gold mining in Bukit Koman, iron ore refinery in Teluk Rubiah, destructive energy development corridor in Sarawak, proposed nuclear plants, massive dams and forest clearance, will bring serious irreversible environmental destructions and suffering to our people of this generation and generations to come.
“It is clear all these were the result of blatant corruption, abuse of power and collapse of administrative functions,” said Wong Tack, chairperson of Himpunan Hijau.
Himpunan Hijau has decided to turn the coming Merdeka Day into a truly GREEN Merdeka Day. This national campaign will evoke patriotic spirit and empower the people to free our nation from all these dark forces and restore our country’s dignity and sovereignty.
Therefore, to make this Merdeka day meaningful, we urge all Malaysians to rise up and send the strongest message to the current regime. The rakyat have grave concerns about the wellbeing of our future generations. The rakyat want to have a say on how the country should be run. Putting on a green T-shirt is the simplest way for all of us to display our patriotic spirit to our beloved nation. We encourage people to use their own imagination and creativity to hold peaceful community green gatherings or events to express this spirit. Make it EXCITING, make it INTENSE, with strong message, yet in the most peaceful manner!

“Judging from the continuos irresponsible actions, gimmicks and lies from the current regime, we believe MOSTI and AELB will issue the Temporary Operating Licence in the very near future.
“When that moment comes, we are certain people will come all out for the final battle,” said Wong Tack.
“As I criss-crossed across the nation, I have observed that responsible Malaysians have gained strong awareness and will not tolerate injustice. They have expressed strong commitment to respond to Himpunan Hijau BLOCKADE campaign’s clarion call to join their brothers and sisters in Kuantan to ensure not an ounce of Lynas’ toxic ores reach our shores,” added Wong Tack.

Australian rare earths mining firm Lynas Corp. has scored another win, this time against the Malaysian group which has been spreading false claims against the safety of the miner’s rare earths processing plant in Malaysia.
On Tuesday, the protest group Save Malaysia Stop Lynas (SMSL) published an apology letter to Lynas Corp in the news portal http://www.freemalaysiatoday.com.
“We refer to the articles previously published by us which claim that the Lynas plant may be unsafe,” SMSL’s letter went. “We apologise for these publications as such claims do not have a scientific basis. The regulatory review of the Lynas plant has been thorough and diligent.”

KUALA LUMPUR (July 17, 2012): Lynas Corporation Limited, which has been receiving adverse publicity for over a year arising from its rare earth processing plant in Pahang, feels vindicated following an apology from Free Malaysia Today, an on-line news portal.
Its Chairman Nick Curtis said Lynas had always maintained that its plant at the Gebeng Industrial Estate, near Kuantan, was safe to the community within which it operates, and had based this view on scientific facts.
“The plant was thoroughly tested during the extensive and efficient reviews by the relevant regulators,” he said in a comment emailed to Bernama when asked on the portal’s apology.
In its website, www.freemalaysiatoday.com, Mtoday News Sdn Bhd apologised over articles it had published previously, claiming that the Lynas plant may be unsafe to the people.
“We apologise for these publications as such claims do not have a scientific basis. The regulatory review of the Lynas plant has been thorough and diligent,” it added. – Bernama

July 19 hearing for Lynas injunction
Defendants need time to file affidavit-in-reply, says SMSL.
KUALA LUMPUR: The High Court postponed to July 19 the inter-partes injunction hearing by Lynas Corporation Ltd and Lynas Malaysia Sdn Bhd to restrain “Save Malaysia, Stop Lynas” (SMSL), an anti-Lynas group and its two directors from further publishing defamatory article on Lynas.
SMSL’s counsel Bastian Pius Vendargon told reporters that Lynas had served its affidavit pertaining to the injunction hearing to the defendants yesterday.
He said the defendants needed time to file its affidavit-in-reply and the court fixed July 19 to hear the inter-partes injuction.
He also said that both parties had submitted written submissions on the injunction to the court.

I would like for all of you to get it throught you thick heads as it is very obvious, even to call you guys bird-brains is above expectations. All I can say is that I am glad that I am not working in Malaysia watching countless number of people going to jail. Having said that, I want to make it quite clear Lynas WILL operate! It does not matter how many flags you take with you, how many idiots you bring with you, majority being fruit-pickers, potato-growers and the unemployed, Lynas WILL start operations! The present government will get elected again, again you guys can go to the streets, jumping up and down like monkeys, showing your ugly faces, throwing bricks at the police cars, even trying to kill the police for that matter, because that is your style and my offer of free psychiatric evaluations is still open to all the knucklehead protestors. I am considering opening a psychiatric ward next door to Lynas and a police station. I will be handing out doctor’s certificates to each and everyone of the protestors and when you are cleard of not being a psychopath, you will be given a green card and with that green card, you will take it to the ceremonies conducted every month, where you will go and kiss the current prime minister’s feet and apologise for being trouble makers!
We’re free enough as a democracy to be allowed freedom of speech to quite a large extent but it would help everyone if you could put your view across in a more rational and coherent way. What comes across is strong raw emotion. You feel strongly, but the passion comes across in a way that, instead of helping readers focus on your view, bring out their reaction. What did Malaysia contribute to the world, apart from constantly saying you have a corrupt government, the police are corrupt! That is what you are famous for! The truth is you would not have a clue about democracy! And I am not talking about the government, nor the police. I am talking about all the uneducated potato-pickers like yourself! In democracy, you talk about the truth, you do not create a lie and continue with it and if you believe in that lie, you are obviously very ill. I have estimated that I am going to make more money than Lynas, per annum, as I can see, there is a possibility that 80% of Malaysians could be psychos! What I am trying to say is, Get it thru your thick head! You all need help! I am serious! You have created a lie, a fantasy like Batman and Robin and you believe in it! This could be a source of di-polar and as I mentioned before, stop by my clinic and who knows, maybe you will be cured and get a green pass to go to kiss current prime minister’s feet within a couple of weeks.
