PUTRAJAYA, Feb 1 — The Federal Court ruled on Wednesday that a person who lodges a police report could be held accountable for defamation if he or she repeats the contents of the report to the public.
Justice Tan Sri Azahar Mohamed said subsequent publication of the contents of a police report by its maker to the public was not protected by the defence of absolute privilege save where the contents of the report were made in or in connection with judicial proceedings.
In his 15-page judgment, he said there was no public policy consideration to recognise that once the police report was absolutely privileged it remained so at whatever occasion it was subsequently published.
“The right of the maker of the police report to speak and write freely to the public at large cannot override an individual’s interest in protecting his reputation,” said Justice Azahar, who delivered the judgment of a five-man bench in a defamation lawsuit brought against actress Zahida Mohamed Rafik.
He said the absolute-privilege defence must at some point give way to protection against reputational damage.
Justice Azahar said it would result in persons irresponsibly slandering others with impunity if the defence of absolute privilege was extended to cover the subsequent publication of the contents of the police report to the world at large.
He said that in the present case, Zahida did not offer justification or explanation why it was necessary or reasonable for her to repeat the contents of the police report at a press conference.
However, he said, although the court answered the legal question pertaining to absolute privilege in favour of Zahida’s former driver, Noor Azman Azemi, it would not affect the result of his appeal.
In dismissing Noor Azman’s appeal with no order as to costs, Justice Azahar said no serious miscarriage of justice had occurred.
Noor Azman had appealed against the Court of Appeal decision which set aside the RM150,000 damages awarded to him by the High Court in his defamation suit against Zahida.
Noor Azman, a driver for a private company, would also have to return RM200,000 to Zahida as the Federal Court had upheld a Court of Appeal decision on her counter-claim against him (Noor Azman).

Court sets aside defamation against actress by ex-driver
Court of Appeal rules Zahida Rafik could not have defamed her former driver by merely reading out contents of a police report over alleged RM200,000 theft.
PUTRAJAYA: The Court of Appeal today reversed the findings of a High Court that actress Zahida Mohamed Rafik had defamed her ex-driver who allegedly took RM200,000.
A three-woman bench led by Lim Yee Lan also allowed a counter claim by Zahida that Noor Azman Azemi return the money to her.
Zahida, who was represented by Muhammad Shafee Abdullah, was also awarded further costs of RM50,000.
Justice Hasnah Mohammed Hashim, who delivered the judgment of the court, said Zahida could not have defamed Noor Azman by merely reading out the contents of a police report made against the ex-driver.
“The report is a defence of absolute privilege,” Hasnah said.
The other judge on the bench that delivered the unanimous ruling was Badariah Sahamid.

Actress Zahida ordered to pay ex-driver RM150,000 in damages
KUALA LUMPUR: The High Court here ordered local actress Zahida Mohamed Rafik to pay her former driver RM150,000 in damages, after ruling the actress had defamed him.
Justice Hue Siew Kheng said on Thursday that Zahida’s statements in a Malay tabloid – that Noor Azman Azemi supposedly took RM200,000 of her money – amounted to libel.
She added that Zahida’s defence of ancillary privilege and justification failed as her witnesses and some of the evidence tendered were not credible.
The court awarded Noor Azman RM150,000 in damages and RM40,000 in costs.
Justice Hue Siew also dismissed Zahida’s counter claim for the return of RM200,000 allegedly taken by the driver.
The Judge dismissed an application by Zahida’s lawyer Sarah Abishegam to stay execution of the order.
Noor Azman had filed the suit against Zahida on Nov 27, 2013, over an article titled “Zahida Rafik Terkedu”, where she accused him of running away with the RM200,000 after he was ordered to deposit it in her bank account.

KUALA LUMPUR: A Malaysian actress’ former driver claimed trial in the Ampang Magistrate’s Court here to criminal breach of trust (CBT) involving RM200,000.
Noor Azman Azmi, 40, now a taxi driver allegedly misappropriated the money belonging to his employer Zahida Rafik, 40, who had entrusted him to deposit it into her bank account.
The single father of two who was arrested Thursday, is accused of committing the offence at Lot 186 Lorong Kempas 2, Kampung Melayu Ampang at 11.30am on Feb 29, 2012.
Counsel Eric Paulsen told the court that Noor Azman also had an ongoing civil case in the High Court, in which he was suing Zahida for accusing him of misappropriating her money.
Magistrate Ayuni Izzaty Sulaiman set bail at RM20,000 with two sureties and ordered the accused’s passport to be temporarily impounded; she also fixed Nov 20 for mention.

Actress Zahida Rafik fails to strike out defamation suit
KUALA LUMPUR: Actress Zahida Rafik failed to strike out a defamation suit against her filed by her former personal driver for allegedly implying he was a thief.
High Court Judge Hue Siew Kheng ruled that it was not a proper case to be summarily dismissed.
Justice Hue also rejected an application by Zahida to stay the court ruling.
She ordered Zahida to pay RM3,500 in costs after meeting the parties in chambers.

PUTRAJAYA, Feb 1 — Zahida Rafik’s former driver, Noor Azman Azemi, 39, was at the office of the Malaysian Anti-Corruption Commission (MACC) here to give his statement on a claim of the artiste receiving a huge sum of money from Rural and Regional Development Minister Datuk Seri Mohd Shafie Apdal (picture).
Noor Azman’s lawyer, Latheefa Koya, who is Parti Keadilan Rakyat (PKR) legal bureau chairman, said her client was at the MACC office for about an hour to facilitate investigations carried out under the Anti-Money Laundering and Anti-Terrorism Financing Act.

The Malaysian Anti-Corruption Commission (MACC) has called the former driver of actress Zahida Mohamed Rafik for questioning on a matter believed to be linked to his allegation in May last year about Zahida and Rural Development Minister Shafie Apdal.
Noor Azman Azemi, accompanied by PKR legal bureau chief Latheefa Koya and his aunt, renowned 1980s singer Dayangku Intan, arrived at MACC headquarters in Putrajaya around 10am.
Latheefa told reporters that she believes it is linked to Azman’s allegation, made in May last year, that he witnessed Zahida making a bank deposit of RM1 million that was said to have been received from Shafie.
Both Zahida and Shafie have denied the allegation and threatened to take legal action against their accusers.

Azman came out of the building at around 1.17pm after a 90-minute statement recording session.
