THE DEPUTY PRIME MINISTER

1. I was browsing through the Federal Constitution when suddenly I found the incongruity of the provision under Article 33A.
2. It reads as follows: “Yang di-Pertuan Agong shall cease to exercise the functions of the Yang di-Pertuan Agong if charged with an offence”.
3. It is obvious that being charged with an offence is so serious that a person such as the Yang di-Pertuan Agong would cease to exercise the functions of the Yang di-Pertuan Agong.
4. It does not say that he would have to be found guilty before His Majesty ceases to exercise his function. Being charged is clearly serious enough for the constitution to prescribe the cessation of his function.
5. Now, what about a lesser functionary such as a Deputy Prime Minister. He has been charged with over 40 charges. Yet he is appointed a Deputy Prime Minister and continues to hold that post.
6. Is the DPM a more senior functionary that he should be better treated than the Yang di-Pertuan Agong?
7. There is a need for Reform here, me thinks.

TIMBALAN PERDANA MENTERI (Terjemahan)

1. Saya membelek Perlembagaan Persekutuan, tiba-tiba saya dapati perbezaan dalam peruntukan di bawah Artikel 33A.
2. Bacaannya seperti berikut: “Yang di-Pertuan Agong hendaklah terhenti menjalankan fungsi Yang di-Pertuan Agong jika dipertuduh atas suatu kesalahan”.
3. Jelas sekali bahawa dengan hanya didakwa dengan kesalahan sudah dianggap serius hinggakan individu seperti YDP Agong terhenti fungsi-fungsi sebagai YDP Agong.
4. Ia tidak menyebut perlu didapati bersalah terdahulu maka fungsi Baginda terhenti. Dengan hanya didakwa sudah jelas bahawa perlembagaan menetapkan terhentinya fungsi Baginda.
5. Sekarang bagaimana pula dengan jawatan yang lebih rendah seperti Timbalan Perdana Menteri. Dia sudah didakwa dengan 40 pertuduhan. Namun dia masih dilantik sebagai TPM dan masih menjawat jawatan itu.
6. Apakah fungsi TPM lebih tinggi hinggakan dia dilayan lebih tinggi berbanding YDP Agong?
7. Ada keperluan bagi Reformasi di sini, pada fikiran saya.
8. Takpalah, saya akan jaga cucu sekarang. Lupakan saja perkara ini.
