1. A 38-year old male foreign tourist had drowned while 8 other foreign tourists were rescued, after their boat capsized off Semporna, Sabah yesterday (Sept 4).

3. Supt Mohd Farhan said the incident is being probed under Section 304A of the Penal Code for causing death by negligence.
