Lawyers For Liberty wants A Gani Patail to be probed for:
1. His conduct in the Altantuya Shaariibuu case as head of prosecution.
2. His role in “notorious reformasi-era, politically motivated prosecutions” including the reportedly forced confession, prosecution and jailing of Anwar’s former speech writer Munawar Anees.
3. His role in using his power as prosecutor to approve nine charges against Zunar the cartoonist and several others.

We refer to the statement yesterday by former CJ Abdul Hamid Mohamad criticising A-G Tommy Thomas’ announcement that the AG’s Chambers will no longer represent the EC in court, and alleging that Thomas had said that he would not conduct any prosecutions.

Hamid claims that Thomas has no experience in prosecution work; and compares him unfavourably with former A-G Abdul Gani Patail, who he claims is capable and has led many high-profile prosecutions.

This is bizzare and laughable.

Among Gani Patail’s ‘high-profile prosecutions’, which Hamid praises, are the notorious reformasi era politically-motivated prosecutions, during which time Gani Patail was head of prosecution.

Among these tainted prosecutions by Gani, was the forced confession, prosecution and jailing of the innocent Dr Munawar Anees, who is still pleading for justice for what was done to him over 20 years ago. For this, Gani was directly responsible as the head of prosecution.

Just as bad is the more recent Altantuya prosecution, in which Gani Patail as A-G shockingly refused to appeal the acquittal of Abdul Razak Baginda, who is Najib Razak’s close associate.

Worse, during the course of the Altantuya trial, the prosecution itself introduced evidence which was favourable to the accused. It is a fundamental rule that this is never done by the prosecution in criminal trials, unless they intend to adduce other evidence to rebut the favourable evidence.

Why were the very basic rules of proper prosecution ignored in this instance?

The Altantuya prosecution presided by Gani as A-G has become so discredited, that police and the new government have now announced the re-opening of the Altantuya murder investigation.

In fact, Gani himself should be investigated over his actions in the Altantuya case and the other earlier cases.

Is Hamid seriously holding up Gani Patail as an example against the untainted Tommy Thomas?

PETALING JAYA: Lawyers for Liberty (LFL) today called for former attorney-general Abdul Gani Patail to be investigated over his conduct in the Altantuya Shaariibuu case as well as other earlier cases during his time as head of prosecution.

The rights group said Gani’s conduct as prosecutor during the murder trial of Mongolian citizen Altantuya Shaariibuu was questionable, adding that he was also guilty of selective prosecution against Anwar Ibrahim in the late 1990s.

In the Altantuya trial, LFL adviser N Surendran said, Gani “shockingly refused to appeal the acquittal of Abdul Razak Baginda”.

Razak was an aide to former prime minister Najib Razak, who was acquitted of the murder charge without his defence being called.

Surendran also recalled Gani’s role in “notorious reformasi-era, politically motivated prosecutions” including the reportedly forced confession, prosecution and jailing of Anwar’s former speech writer Munawar Anees.

Home Ministry to re-evaluate ban on Zunar book

THE gazetted ban on cartoonist Zunar’s book, Sapuman – Man of Steel, will be re-evaluated by the Home Ministry.

His lawyer, N. Surendran, today said federal attorney Muzilah Mohd Arshad has informed judge Azizah Nawawi that the Attorney-General’s Chambers will wait for further instructions from the ministry.

Azizah then delayed the hearing of Zunar’s case challenging the ministry’s ban on his artwork.

The book, published in Bahasa Malaysia and English, was banned in October last year.

“In 2014 and earlier, when Gani was A-G, a lot of opposition politicians were charged under this cruel act.

“Gani has to explain why he did that or gave such orders,” said the lawyer, who is also facing charges under the Sedition Act after he commented on the hearing of PKR de facto leader Anwar Ibrahim in 2014. – June 7, 2018.

Clear my name too, says Munawar Anees

PETALING JAYA: Dr Munawar Anees (pix), who had served six months in prison in 1998 over a sodomy charge, has appealed to Prime Minister Tun Dr Mahathir Mohamad to clear his name.

The former speechwriter of Pakatan Harapan (PH) defacto leader Datuk Seri Anwar Ibrahim said he had committed no crime and was a mere pawn in a power game.

In an open letter to Mahathir, he said: “You and Anwar Ibrahim seem to have turned a page. That is commendable. But where is the justice me and my family deserve?”

It has been 20 years since Malaysian police threw me in jail on trumped-up charges merely because I was associated with Anwar, he said.

“I had committed no crime, yet the police came to my home and took me away,” he said. “When my children came back from school that day, their father was gone. Their mother was left alone to explain to them what had happened.”

He accused the police of trying to wrongfully implicate him in crimes with Anwar.

“At first, I refuted the allegations and strongly resisted any suggestion to implicate me in any offences. That is when the torture started,” he said.

Munawar said he was subjected to beatings and being doused in freezing water, and was deprived me of sleep and food.

“The torture had such a serious effect on me that I suffered a heart problem and had to be taken to the hospital. It was there that, for the first time, I was allowed to see my family,” he said.

“After weeks in torturous custody, I relented. I told my torturers – your police officers – what they wanted to hear. None of it was true. All of it was said to make the torture stop. When I was presented before court I repeated what I had said to the police, fearful that to say otherwise would mean being tortured again.

“Grim details of my torturous detention under the Internal Security Act may be found in my statutory declaration of Nov 7, 1998.”
