Najib: 10-point resolution on Allah issue subject to Federal, state laws

KUALA LUMPUR: The Umno Supreme Council on Friday threw its support behind the Government’s stand in defending the position of Islam, including on the use of the word Allah (kalimah Allah), said Prime Minister Datuk Seri Najib Tun Razak.

Najib, who is also Umno president, said the Supreme Council also took note of the Cabinet’s 10-point resolution on this matter in 2011, which among others, allows the Christian community in Sabah and Sarawak to continue using the word Allah in the Malay version of the Bible.

However, he said the points therein were subject to Federal and state laws.

“This means that if the state has an enactment (on use of the word Allah), it is subject to this. If the state does not have such an enactment, like Sabah and Sarawak, so the usual practice will be continued and no party should scare others,” he told reporters after chairing the Umno Supreme Council meeting at Menara Dato Onn on Friday.

Najib said the ninth item in the resolution also specifically states that it was subject to Federal and state laws.

It is paramount for Christians and churches to realize that Najib’s 10-point Solution is IMPOTENT. It is merely a Cabinet directive and not legislation. Law trumps directive everytime.

‘Give back our Bibles’, demand Iban Christians

Iban Christians consider the seizure of the Malay and Iban Bibles as an infringement of their constitutional rights to practice, preach and propagate their faith.

KUALA LUMPUR: The Federal Cabinet must immediately order the release of the Malay and Iban Bibles seized from the Bible Society of Malaysia (BSM), and allow Bumiputera Christians to practice their religion in peace,  urged Gempuru Besai Sarawak.

The Christian network, which represents some 6,000 Iban speaking congregations in Sarawak, said MBS was the sole importer and printer of the Alkitab and Bup Kudus, and the raid had disrupted the community’s right to practice their faith.

“We are alarmed that [the Selangor Islamic Religious Department] has been vested with authority to seize these Bibles which are meant for Bumiputera Christians in Sarawak.

“We consider the seizure of our Alkitab and Bup Kudus a serious and intolerable infringement of our constitutionally guaranteed right to practice, preach and propagate our faith,” Gempuru Besai Sarawak chairman Pastor Greman anak Ujang said in a statement yesterday.

He said Jais’ raid on Jan 2 breached the promises contained in the 10-Point Federal Cabinet Agreement and the country’s Constitutional Guarantee of Religious Freedom.

It also nullified Prime Minister Tun Razak’s verbal assurance that the Court of Appeal decision prohibiting Christian publication Herald from using the word ‘Allah’ would not apply to East Malaysian Christians, he said.

THE 10 POINT SOLUTION

1 Bibles in all languages can be imported, including in Bahasa Malaysia/Indonesia.

2 These Bibles can also be printed locally in Peninsular Malaysia, Sabah and Sarawak.

3 Bibles in indigenous languages of Sabah and Sarawak such as Iban, Kadazan-Dusun and Lun Bawang can also be printed locally and imported.

4 For Sabah and Sarawak, there are no conditions attached to the importation and printing of the bibles in all languages, including Bahasa Malaysia/Indonesia and indigenous languages.

5 Bibles in Bahasa Malaysia/Indonesia must have the words “Christian Publication” and the cross sign printed on the front cover.

6 No restrictions on people bringing Bibles and Christian materials on travel between Sabah and Sarawak and Peninsular Malaysia.

7 A directive on the Bible has been issued by the Home Ministry to ensure proper implementation of this Cabinet decision and failure to comply will subject officers to disciplinary action under General Orders.

8 For impounded Bibles in Kuching, the importer can collect all the 30,000 Bibles free of charge.

9 Government to work with Christian groups and other different religious groups to address inter-religious issues.

10 Christian ministers will meet regularly with Christian groups to resolve religious issues.

ANALYSIS Brokered in the lead up to the Sarawak election in 2011, the 10-point solution was hailed as a policy directive which managed to find the middle ground.

But will the 10-point solution – which allows the use of the Bible in Bahasa Malaysia and indigenous languages – protect Christians from prosecution in Peninsular Malaysia?

According to lawyer Syahredzan Johan, the answer is “no” for the simple reason that it is not a piece of legislation.

He said the 10-point solution, as well as any cabinet directive, is impotent when faced with state legislation barring the use of the word ‘Allah’ by non-Muslims because this is “out of the federal jurisdiction”.

The federal government, he said, can only use the 10-point solution to allow Christians to use the Bahasa Malaysia and other indigenous language Bible in the federal territories, but not in states which have legislated against it.

So if the Bible Society of Malaysia (BSM) pair is charged for having copies of the Bahasa Malaysia and Iban language Bible at their premises, the two cannot argue their case based on this.

“No… The 10-point solution matters not,” Syahredzan replied when asked if it can be used as a defence.

According to Syariah Lawyers Association (PGSM) president Musa Awang (right), Section 9 of the enactment states that non-Muslims using prohibited words in writing or public speech can be fined up to RM1,000.

This means that whenever a church in the 10 states holds a service in Bahasa Malaysia or in an indigenous language where the word ‘Allah’ is used, the church and its congregation run the risk of a raid, arrests and being slapped with fines.

MB orders Jais to consult Home Ministry

The Selangor Islamic Department (Jais) will be ordered to return copies of the Bible that they seized on Jan 1, if the publication fulfils Putrajaya’s 10-point solution on Christian texts.
This was announced by Selangor Menteri Besar Abdul Khalid Ibrahim after a marathon eight hour meeting with his state exco members.
He said that for now, Jais will have to consult the Home Ministry on whether the Bibles seized from the Bible Society of Malaysia (BSM) fulfils the stipulations within the 10-point solution.
Khalid explained that this was necessary as the Home Ministry is the regulator for the import, use and printing of Bibles in the Malay language.

“If the Home Ministry is satisfied that the (seized) copies fulfil the 10-point solution, then the state government will order Jais to return them to the BSM,” he said during a press conference today.

The first state to gazette this legislation was Kelantan in 1981. In the following decade, nine other states adopted almost identical legislation, with Johor being the last in 1991.

What this means is that for non-Muslims who would like to use the word “Allah”, it would be best for them to pack their bags and move to Penang, Sabah, Sarawak and the federal territories.

According to Syariah Lawyers Association (PGSM) president Musa Awang, Section 9 of the enactment states that non-Muslims using prohibited words in writing or public speech can be fined up to RM1,000.

He said that using these words, including “Allah”, to “state a fact, belief, idea, concept, activity or anything about or related to a non-Islamic religion” is an offence.

Although other sections clearly deals with propagation, it is an offence for non-Muslims to use “Allah” under Section 9 “even if it is not for the purpose of propagating to Muslims”.

And better still, it is a “seizable offence” which means that an “investigation” – a term Musa feels is more appropriate than “raid” to describe the BSM incident – and arrests can be carried out without a warrant.

“This is a seizable offence under the Criminal Procedure Code, where authorised officers can investigate under the enactment and arrest suspects without any warrant,” he said.

This means that whenever a church in the 10 states holds a service in Bahasa Malaysia or in an indigenous language where the word “Allah” is used, the church and its congregation run the risk of a raid, arrests and being slapped with fines.  – Mkini
