Wives and lawyers cause a stir

KUALA LUMPUR: There were tears and shouts outside a magistrate’s court here after Insp S. Hare Krishnan was charged in connection with the death of N. Dhamendran while in custody.
Dhamendran’s distraught widow Marry Mariya Susay shouted outside the courtroom, asking why it took over two months for the accused to break his silence.
“I don’t believe him now. Why didn’t he say anything earlier?
“I hope he starts talking at the next mention. I will wait for Aug 2 and see what happens,” she said.
Moments before, Insp Hare Krishnan’s wife Shaarmini Balakrishnan, who had been maintaining her composure during court proceedings, burst into tears outside after her husband was taken away.
She continued sobbing and wiping her tears as she walked quickly away from the court, declining to talk to reporters.

Inspector S Hare Krishnan today became the fourth police officer charged with the murder of N Dhamendran, who died in police custody on May 21.
Hare Krishnan, 40, was charged in the Kuala Lumpur Magistrate’s Court, under Sections 302 and 34 of the Penal Code, which carry the mandatory death penalty upon convinction.
No plea was recorded.
Magistrate Nur A’minahtul Mardiah Md Nor said the mention date will be fixed upon availability of the post-mortem report, which is expected on Aug 2.
The accused was represented by S Kavita and N Kalyana Sundaram.
Hare Krishnan was charged less than 24 hours after surrendering to the police at the Dang Wangi police district headquarters yesterday morning.
The police have stated that he has been in hiding since June 15, a claim which the accused and his family have since rebutted.
Hare Krishnan has claimed innocence in Dhamendran’s death, alleging he is merely a scapegoat to “protect certain parties”.

Shaarmini further said Hare Krishnan made a statutory declaration recording his innocence in the Dhamendran case.

Shaarmini Balakrishnan (right in photo) told Malaysiakini today that Hare Krishnan did not turn up for work after his leave ended on June 15 because he had been told that he was suspended from duty.
Since then, she said, Hare Krishnan had engaged a lawyer who has sent numerous letters to the police, but there has been no reply.
“He was never on the run. The lawyer was also available (for the police) to contact,” she said.

S Hare Krishnan, the police officer sought in connection with the custodial death of N Dharmendran, surrendered this morning and is expected to be charged tomorrow.
He surrendered at the Bukit Aman police headquarters at 10.30am and was later brought to the Dang Wangi district police headquarters at 11am to have his statement recorded.
Earlier, confusion reigned over Hare Krishnan’s appearance in court as his family claimed that he was being charged today.
Hare Krishnan, who had been in contact with his wife Shaarmini Balakrishnan since surrendering, had sent her a text message claiming that he would be charged this afternoon.
The police however later clarified that he would be charged tomorrow.

Shaarmini, who turned up at the Dang Wangi police headquarters, with six other family members, expressed surprise when she learned of Khalid’s announcement.
“They have not concluded investigations and they want to charge him,” she said.

See3: If inspector S Hare Krishnan claims to know who was actually responsible for the death of N Dhamendran, he should better come clean and quick.
If he doesn’t trust the police force that he will get a fair hearing, he should go through other means, such as the alternative media.
Otherwise, continuing to be on the run makes it easier for the guilty parties to pin the murder on him.
Peacemaker: Hare Krishnan has taken a very long time to come up with this explanation. It arouses suspicions of fabrication of evidence. Why was he on the run if he was innocent?
Did he not trust his colleagues should he surrender to them? Come on Hare, you’ve got to spill the beans or your credibility is finished.
Lover Boy: I somehow feel that Hare Krishnan is more concerned about being set up and his life threatened than the Dhamendran case itself. Could that be the reason he went into hiding?
Sabahan: I find it strange that Indian police officers are usually implicated in lock-up deaths involving Indians. Are there that many Indian police officers and are they all thugs?
Something inside me says that the Indians are being victimised, period. It makes no difference if they are police officers or gangsters.
SS Dhaliwal: Hare Krishnan in all likelihood is a scapegoat and probably knows he will take the fall. He should make an statutory declaration to be kept by his lawyers revealing all as his trump card in the event he is jailed.
Maybe he might get away scot-free just like political analyst Abdul Razak Baginda, who was acquitted of the charge of murdering Mongolian national Altantuya Shaariibuu.
Yap CS: Police personnel will now know only those cronies of the BN will be protected. So if you are not a crony of BN, better leave the force or you will be blame for everything bad that is happening now.

EXCLUSIVE Inspector S Hare Krishnan, the fourth suspect in N Dhamendran’s custodial death, says he is innocent and claims he was dragged into the case to “protect certain parties”.
This was revealed in a police report Hare Krishnan made on June 1, nine days after Dhamendran’s death on May 21, and two weeks before the inspector went into hiding.
A copy of the report obtained by Malaysiakini states that Hare Krishnan was not even in the Dang Wangi police station lock-up on the day Dhamendran died after horrific torture.

In his police report, Hare Krishnan says he was on May 21 instructed by a superior officer to “release and re-arrest” Dhamendran while he was having lunch at a restaurant in Cheras.
The inspector said he subsequently ordered his subordinates to do so, but later discovered that Dhamendran’s re-arrest was done using his (Hare Krishnan’s) identification, without his consent.
“The officers made the arrest report using my PRS ID without my approval,” Hare Krishnan says in the report, which also states that he had gone back home right after lunch as he had a night raid to conduct that day.
He was notified of Dhamendran’s death at 4.30pm that day.
Hare Krishnan claims that there was an instruction to include his name in the lock-up diary, something which was also done without his knowledge and permission.
“All the entries of me in the lock-up diary are untrue and were done to implicate me and protect certain parties,” he says in his police report.

LFL Press Statement: PDRM not serious in apprehending the fugitive police inspector in Dharmendran’s murder
On 21 May 2013, the nation was shocked by news of N.Dharmendran’s death after being detained for 10 days at IPK Kuala Lumpur with his body showing clear signs of torture, having among others things staples still attached on his ears.
Even though Kuala Lumpur CID Police Chief Ku Chin Wah initially tried to play down his death by saying he died from “breathing difficulties or asthma,” however after pressure from the deceased family’s lawyers and the post-mortem which confirmed that he died from beatings, three police officers Sergeant Jaffri Jaafar, Corporal Mohd Nahar Abdul Rahman and Corporal Mohd Haswadi Zamri Shaari were finally charged for murder on 5 June 2013.
However, a fourth police officer suspect, having the rank of inspector remains at large. Until today, the police have withheld his identity and have not revealed his photograph or other details that would assist in his swift apprehension. There also do not seem to be any public alerts or manhunt for the inspector despite the high profile nature of the crime.
The PDRM’s lackadaisical and irresponsible attitude should be contrasted with the Singapore Police Force which recently had to address a gruesome double murder by one of their officers. On 13 July 2013, Ng Joo Hee, Singapore Police Commissioner in a public apology stressed that “the public’s trust in the police is the only reason they are able to keep Singapore as safe as it is … this trust is hard-earned and must never be broken” and vowed to prosecute the officer to the maximum extent for the heinous crime that he is accused of committing.
The PDRM are well advised to emulate their counterpart’s attitude in Singapore by taking crimes committed by their officers more seriously and addressing the public’s lack of trust and confidence rather than playing down or covering up crimes perpetrated by one of their own.
We therefore call upon the PDRM to utilise their vast resources and swiftly apprehend the inspector concerned and prosecute him to the maximum extent for Dharmendran’s murder.

Police have today released the name and photograph of an inspector who is the fourth suspect wanted for the murder of N Dhamendran, who died in police custody.
In a press release late this evening, Kuala Lumpur criminal investigation department (CID) chief Ku Chin Wah,revealed that the officer was Inspector Hare Krishnan K Subramaniam.
Ku stated that Hare Krishnan was serving in his department but has been absent without leave since June 15.
“(Hare Krishnan) is also wanted to assist in investigations of a death in Tun HS Lee lockup, report number: 18468/13,” the statement reads.
Although Ku’s press release did not mention Dhamendran’s name at all, he confirmed that Hare Krishnan was the fourth suspect when asked by Malaysiakini.
Furthermore, the police report number quoted by Ku’s press release is the same police report number stated in Dhamendran’s autopsy report.

The Kuala Lumpur High Court today acquitted four police officers of the charge of murdering detainee N Dharmendran at the KL police lock-up.
The court’s judge Kamardin Hashim found there was no prima facie case against the four.
They are Inspector S Hare Krishnan, 41, from Sungai Petani Kedah, Sergeant Jaffri Jaafar, 45, Corporal Mohd Nahar Abd Rahman, 46, and Corporal Mohd Haswadi Zamri Shaari, 33.
They were charged with committing the offence at the D9 investigation office, 7th floor, Kuala Lumpur police contingent headquarters on Jalan Hang Tuah here between 12.20pm and 2.50pm on May 21, 2013.
The post-mortem found that Dharmendran had staples on his ear lobes and ankle, sparking widespread outcry.
A total of 58 witnesses were called by the prosecution.
Justice Kamardin said it was unsafe to rely on circumstantial evidence to call all four policemen to enter their defence.
He said even Inspector Hare Krishnan was not at the scene.
