Fake: Supreme Court ruled that “Covid vaccines are not vaccines”.
Fact: A New York State Supreme Court Justice recently ruled the stateâs Covid-19 vaccine mandate for health care workers is “null, void and of no effect”.

Before we get too deep into the significance of this courtâs decision, we need to remember this is a trial-level court and any appeal could reverse its conclusions.

A New York Court Just Reinstated Fired Unvaccinated Workers â What That Could Mean For Workers Across The Country

.
On October 24, 2022, Judge Ralph J. Porzio issued an order essentially dismissing the Respondentâs arguments and accepting most of the Petitionersâ arguments. The order commanded that all terminated Petitioners be reinstated on October 25, 2022 and collect back pay from their date of termination.
.
After concluding the Petitionersâ suit was filed on time, the court held that the vaccination mandate was unlawful for several reasons.
First, it was arbitrary and capricious. The court looked at EO 62 and argued that it treated similarly situated people differently without providing evidence to support the unequal treatment.
Second, the NYC Department of Health and Mental Hygiene violated the separation of powers doctrine. This occurred because the vaccination mandate unilaterally and indefinitely changed the terms of the Petitionersâ employment. The court stated that these were powers that the NYC Department of Health and Mental Hygiene shouldnât have.
Third, the vaccination mandate was effectively a legal mandate that affected the Petitionersâ conditions of employment and that the Health Commissioner of NYC didnât have the authority to make changes to those conditions for employment. The Respondents relied on prior case law upholding vaccination requirements among healthcare workers. The court distinguished those cases because those healthcare workers had always been required to be vaccinated as a condition of employment. But this was the first time the Petitioners had ever had a vaccination requirement placed on them.
Fourth, firing the Petitioners deprived them of equal protection under the law as provided for by the NY Constitution. This was because athletes, performers and artists could be exempted from the vaccination requirement, but the Petitioner could not.
Fifth, the court noted that the Petitioners could continue working while their exemption requests were being processed. Therefore, the court felt that the vaccination mandate was never about public safety. Because if it was, any unvaccinated workers would have immediately been placed on leave until a decision concerning their requests for a coronavirus vaccine exemption.
How the Courtâs Reasoning Could Affect Workers Outside NYC
Before we get too deep into the significance of this courtâs decision, we need to remember this is a trial-level court and any appeal could reverse its conclusions. That being said, if the decision were to survive an appeal (NYC has reportedly filed an appeal already), it may change how employers impose vaccine mandates on their workers.

The Supreme Court hasn’t ruled that mRNA COVID-19 vaccines cause âirreparableâ damage, as recent social media posts baselessly claim. The falsehood is similar to a claim debunked in 2021. (AP Photo/J. Scott Applewhite, File)
CLAIM: Robert F. Kennedy Jr. won a U.S. Supreme Court case against âall the pharmaceutical lobbyistsâ in which the court ruled that mRNA COVID-19 vaccines cause âirreparableâ damage.
APâS ASSESSMENT: False. There has been no such Supreme Court ruling, according to the courtâs comprehensive online archive of opinions. Kennedy, a lawyer who has advocated against vaccines, told The Associated Press in 2021 that articles sharing similar claims were false. At the time, he said he had been involved in dozens of lawsuits regarding vaccine safety, but none had reached the Supreme Court.
THE FACTS: The baseless claim about Kennedy winning a Supreme Court case related to COVID-19 vaccine safety has circulated online for more than a year, driven by fringe blog posts in multiple languages.
Versions of the claim reemerged on Twitter this month. The posts share an image of Kennedy alongside a paragraph of text purportedly describing the recent ruling. The text contains several spelling, capitalization and grammatical errors.
âSupreme Court ruling hardly anyone noticed that Kennedy Jnr won the case against all the pharmaceutical lobbyists,â the text inside the image reads. âIn the ruling, the supreme court confirms that the damage caused by Covid mRNA gene therapies is irreparable. As the Supreme Court is the highest court in the United States there and no further appeals and the appeals have been exhausted.â
âWhy was this news not Front page headlines?â wrote one Twitter user who shared the image.
But a search of the Supreme Courtâs opinion archive shows that no such ruling exists. All of the courtâs rulings from its term in 2020, which would have encompassed the beginning of the COVID-19 pandemic, and 2021, the most recent term, can be found on its website. None of the cases have to do with the safety of mRNA vaccines, or mention Kennedy Jr.
.
Older versions claimed that Kennedy and a group of scientists led a legal challenge against billionaire philanthropist Bill Gates; Anthony Fauci, the countryâs top infectious disease expert; and âBig Pharma,â in which the Supreme Court ruled COVID-19 vaccines were unsafe and ultimately âcanceled universal vaccination.â That claim originated on blogs that regularly publish hoaxes and misinformation and later spread across social media platforms.
